HomeMy WebLinkAbout74-37REPORT NO. 3 REPORT ON APPLICATION FOR REZONING FOR ELVA REID %, 1. information: The subject property is located on Concession 6, Lot 149 in the former Township of Clarke on the south side of Regional. Road 9. The appli- cant wishes to apply for an amendment to the zoning bylaw to allow a small shop for the sale of arts, crafts and antiques within an existing dwelling. The current zoning is Agriculture "A" and retail uses are not permitted. The following dimensions of existing residence and lot conform to the zoning bylaw, lot size, lot frontage' rear yard, side yards and height. The following dimensions of the building and lot do not conform to the bylaw ® front yard required 50 ft., actual 30 ft. Set back from Regional road required 100 ft., actual 90 ft. The area of the dwelling unit to be used for the sale of arts, crafts, and antiques is 396 sq.ft. The total floor area for the building is 1123 sq.ft. The percentage of floor space proposed for the commercial use is 35.2% 2. Comment: This application is straight forward and seems a reasonable request. It proposes approximately 400 sq.ft. of sales area while the rest of the dwelling would remain residential. The land associated with the dwelling will be used for pasture for horses. The existing drive- way .exits on to a section of the county road which is level and straight, so no traffic hazard is created. There is already the required amount of parking space on the lot in good condition with a gravel surface. ® 2 n REPORT NO. 3 The non-conformity of the existing dwelling with some provisions of the by-law does not affect the merits of this application, 3, Recommendation: Since the property will remain primarily agricultural and residential and since the proposed retail area is secondary to agricultural and residential uses, a zoning amendment should be passed to permit the application with the following restrictions: (1) that retail use be restricted to the sale of antiques and handicrafts, (2) that the retail sales area not exceed 400 sgaft, or 35% of the present dwelling unit area. (3) that any advertising be limited to a non - illuminated sign not more than one square foot. (4) that there be no external storage of goods or materials on the property.
