FROM: George Howden, Planning Director John Layng, Planning Consultant June 5, 1974 RE: RESTRICTED AREA BY -LAW FORI�Z,R VILLAGE OF NEWCASTLE On Saturday, May 25th, 1974, George Howden and John Layng presided at a Hearing in the former Council Chamber of the former Village of Newcastle to hear and record objections to the By -law 73 -15, from persons who had notified, in writing, the Village in October and November of 1973• The following is a list of the names of the owners, the location of the property and our recommendations after our inspections of each site: SAM CUREATZ on the Lake Shore Road, east of Arthur Street wants OS -1 changed to RR to permit him to extend his house. The selected site is on highground. Recommendation: Site is acceptable for an extension to this house. Section 3.2 (g) of the Official Plan permits this interpretation in case of inaccurate mapping. MR. RONSBERGER and MR. ANDERSEN joint owners of a property on Lake Shore Road, in Lot 26, B.F. Concession wish the zoning designation changed from R.U. to R.R. The existing lot is 0.182 acres and has a frame cottage on it. Recommendation: Retain present R.U. because there is an existing house. MRS. RUBY BRUNT on the north -west corner of Caroline and Church Street wishes to create one lot on each side of her present house. This proposal was approved by the former Council and by the former Land Division Committee of Northumberland and Durham County, subject to an amendment to this By -law or a minor variance being obtained. See survey. Recommendation: Since this By -law cannot alter frontages of lots for individual cases, permission to subdivide would have to be through the Committee of Adjustment and Land Division Committee. E.R. LOVEKIN wishes Lot 10, Plan A, Newcastle, and part of unnumbered lot on Wilmot Street to be zoned R2 or R3 to permit commercial or multiple residence land use. Recommendation: Since this land is rough and undeveloped and has an open drainage ditch the zoning should be left Rl until more specific development is proposed which would rerequire a change in category. 2 - STAN CROOKALL, south side of Bolton Street at Lake Ontario, third house east of Mill Street, believes that OS -1 category for his prop- erty restricts his plans for future development and reduces its value. Recommendation: The existing use R.R. of this land will continue and OS -1 does not intend to make the Lake beach more available to the public, but it does set practicable limits for structures so that they will not be damaged or demolished by high water, waves or ice. E.G. HAY on Lot 27, south side of King Street wishes Rl designation to be changed to R2 or R3 to allow high density residential use. Recommendation: The existing designation Rl should be kept until specific proposals indicate a higher density. MRS. ISOBEL WRIGHT on the east side of Mill Street,south of C.N.R. track to Metcalfe Street wishes to category of her property changed from R.U. to R.R. Recommendation: Since the same street immediately south is zoned R.R., the property from Mill Street to one -half the distance to a projection of the west side of Manvers Street should be zoned R.R. which would permit one acre lots with minimum frontages of 150 feet from Mr. Wright's present house to Metcalfe Street. This is infilling hetween existing houses. BOWMANVILLE CONSTRUCTION, J. Dejong and E. Vierhout, subdivision plan on Andrew Street, Lot 27, has one corner lot of 7700 square feet with dimensions 77' X 100'. Area required is 8400 square feet in Rl zone. Recommendation: By -law could be amended according to Section 91.2, page 21, to accept the one smaller corner lot. MABLE COBBLEDICK wants to change zoning on Beaver Street to permit a duplex on her vacant lot. Recommendation: Since there is a duplex next door this rezoning for this lot would be acceptable. HAROLD HILL, Concession B.F., Part of twp. Lot 26, wants his land in category R.U. to be zoned Estate Residential. Recommendation: Since this is a Restricted Area By -law based on existing land use, the change to E.R. now would be pre - mature. D.M. WRIGHT, on the north side of Clarke Street,south of the C.N.R. tracks wishes his 5 acre property shown R.U. on Plate "A" to be changed to R1 because these lots each have water and dewer connections. Recommendation: The zoning could be amended to change R.U. to Rl. SCOTT FENNELL can the south end of Lot 28, Concession B.F. has 42 acres in R.U. and OS ®1 category, which he is in the process of developing as a marina. He wishes to have this land zoned as C4. Marinas are not permitted in OS-1. Recommendation: Detailed site plans showing proposed stages of development would have to be presented to the Council before an amendment could be considered. This Bylaw is to establish the existing land use. - 3 - .ANNIE IiLLISON has a 3 acre property in Part of Lot 289 Concession 2, on the east side of B .lditin Street north, just south of the C.P.R. tracks, which she wishes changed from R.U. to R3. Recommendation: Since this property is at a railway embankment and has no municipal services yet, the zoning category R.U. should remain for the time being. MRS. DIANA GRANDPIELD on Lots 14, 15 and 16, Lot 27 Concession B.F. on the south side of Bolton Street west of Arthur Street wants to know the exact line of division between the OS -1 and R.R. on her property and the possibility of structures. Recommendations: The real shore line here can be defined only in terms of dimensions from the centre line of Bolton Street, Because of the danger of high water, waves and ice in the OS -1 zone it would not be practicable or permissable to build any structures in the OS -1 zone, but the intention is not that the beach (OS -1 zone) would be used by the public any more than it has been in the past. There are no boat- houses or docks at these locations now. The actual widening of the OS -1 area, immediately south of this property and the location of the mouth of the creek from the east, would require an accurate survey to determine the permissable location for accessory buildings. E. DUNCAN on Lots 5, 6 and 7, Lot 27, Concession B.F., on the south side of Bolton Street, objects to the division of his property into two zones R.R. and OS -1, and the consequent restriction to build a boathouse or a dock on the beach (OS -1). Recommendation: The location of the real shore line can be defined as a dimension from the centre line cf Bolton Street and accessory buildings for boats could be built on the R.R. part of the property provided minimum yard dimensions are satisfied. It would not be practicable or permissable to build any structures on the beach (OS -1 zone) because of the continual danger of high water, wave action and ice. MRS. E. CARVETH, on the west side of Mill Street, Lot 28, B.F. Concession, objected to her 2.39 acre property being split into R.U., OS -1 and R.R. zones. The R.R. zone is not deept enough to allow for infilling even though the area and frontage of the land is adequate. Recommendation: Municipal Planning Consultants Ltd. have already recommended a change to Plate "A" By -law 73 -15 to create properly sized R.R. zones. MR. & MRS. GUY ROLAND D.LLL211IRE, the owners of Waltona Park, south of Clarke Street and west of Mill Street in Lot 28, Concession 1, wish the present C -4 zone designation on Plat "A" extended east into the OS -1 zone to cover the actual occupation of trailers on OS -1 zone. Recommendation: The C4 zone should be extended to include the whole property but to restrict use to a seasonal trailer camp to avoid damage by ice or water. Consideration should be given to connect present sanitary facilities to new sanitary sewer immediately west of this property on Baldwin Street South. 4 DURHAM COUNTY SENIOR CITIZENS' HOME, application was made by E.R. Lovekin to rezone 3 acres in Lot 27, Concession 1, east of Beaver Street at James, from R.U. to R3 to permit building a Senior Citizens' Home.
