6. Conformity With Official Plan(s) A This land is designated
partly as residential and partly as hazard lands in the approved
Official Plan for Bowmanville. Several lots at the north end
and on the south side of the cul-de-sac are within the hazard
land area.
7. Status of Zoning By -laws �- Approved

8. Conformity With Zoning By -laws ® The site is zoned R2 in the
present by -law and therefore the proposal conforms with present
zoning.

15. Resume of Agency Comments
(1) Town Engineer - Parts of lots 25 and 26 are being
expropriated to provide a drainage easement for the
adjacent subdivision.
(2) Ministry of the Environment - This subdivision cannot
be approved until the capacity of the sewage treat-
ment plant is expanded.
(3) Note that the Ministry of Natural Resources have not
yet replied regarding the inf ringment of the subdivision
into the Hazard Land area.
16. Recommended Modifications - The plan should be modified in three
ways:
(1) To eliminate the lands being acquired by expropriation

(2) To conform to the Conservation Authorities require-
ments.
(3) To provide for a pedestrian footpath from the end of
the cul-de-sac through to the river.
17. Summary and Recommendations a, This subdivision would appear to
require an Official Plan amendment prior to its approval. T
recommend that Council advise the Ministry that it favours the
approval of the proposed subdivision as modified above subject
to the .following three conditions:
(1) That the Official Plan be first amended to the satis-
faction of the Conservation Authority.
(2) That adjacent lands in the applicants ownership
which lie within the flood plain as defined by the
Conservation Authority be conveyed to the municipality.
(In return for this the municipality should not require
any parks dedication within the subdivision or cash-
in -lieu of parks)
(3) That final approval not be given until adequate
sewage treatment facilities are available.
