HomeMy WebLinkAbout74-83REPORT NO. 5 LETTER RE SUBDIVISION DRVEL0PMEqT PROLES 103 On June 18, the town received a letter from the Regional Clerk advising that the Region would be requiring that there be two separate subdivi. sion agreements cover each subdivision. One of these agreements would be an agreement between the Region and the developer and the other between the local municipality and the developer. The Regional agree- ment would cover Regional services only and the local agreement would all other matters required to be dealt with in subdivision development. Specifically, matters of Regional concern as I see them would be as follows: (1) Water supply and distribution. (2) Sanitary sewers. (3) Regional Roads (if any abut or pass through the subdivi. sion.) (4) Regional development charges (lot levies). Now that the procedure for preparing subdivision agreements has been resolved at the Regional levelq I think that the Town must undertake to prepare a standard subdivision agreement to cover all matters of local concern. There are basically throe types of subdivisions for which agreements will be required; (1) Fully urban subdivisions. (2) hamlet type subdivisions (still urban in overall charac- ter but of lower density). (3) Rural estate type subdivisions. The new standard subdivision agreement should contain optional clauses for each type of subdivision. For exampleg we must decide whether or (continued.......) ® 2 - not we require underground wiring, storm sewers, street lighting, curb and gutter etc. in each of these types of subdivision. We must also decide what lot levies we intend to collect for local services in the municipality in each type of subdivision. It is imperative that this question be resolved quickly, because two subdividers have already approached the town to sign agreements for subdivisions already having draft approval. One of these is a small urban subdivision on Scugog Street north of Jackman Road in Bowmanville. The other is a small subdivision in Enniskillen. To some extent it will be possible to utilize the standard subdivision agreement formerly used by the Town of Bowmanville and the site plan agreements already produced for town- housing developments, however, extensive revisions will be required, particularly to eliminate matters of Regional concern and to provide for hamlet and rural types of subdivision. I would recommend that Municipal Planning Consultants Co. be asked to prepare a standard subdivision agreement to be based where feasible and desirable on previous agreementsg but to contain optional clauses to deal with hamlet and rural subdivisions.
