Recommendations,
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. THAT Report PD-162-91 be received;
2 . THAT the application to amend the Durham Regional Official Plan
and the Town of Newcastle Comprehensive Zoning By-law submitted
by Kennedy Youth Services Inc . be referred back to Staff for
further processing and the preparation of a subsequent report.
3 . THAT the interested parties listed in this report and any
delegation be advised of Council 's decision.
1. APPLICATION DETAILS
1. 1 Applicant: Kennedy Youth Services Inc .
1.2 Agent: Aird & Berlis, Barristers & Solicitors
1. 3 Official Plan Amendment:
Seeking approval to amend the designation in the
Durham Regional Official Plan from Major Open
Space to an appropriate designation to permit the
development of a Youth Detention Facility.
1.4 Rezoning: From in part Agricultural (A) and in part
Environmental Protection (EP) to an appropriate
zone or zones in order to implement the above
noted development.

2 . BACKGROUND
2 . 1 In January of 1991 the Planning and Development Department
received an application submitted by Kennedy Youth Services Inc .
to amend the Town of Newcastle Comprehensive Zoning By-law 84-63
in order to permit the development of a Youth Detention Facility.
2 .2 In February of 1991 the Planning and Development Department was
advised by the Region of Durham of an application to amend the
Durham Regional Official Plan in order to permit the
aforementioned development. However, the Regional Planning
Department determined that the information submitted with the
application was incomplete and did not proceed with the
circulation process . The additional information was provided by
the applicant in June of 1991 and the circulation process
proceeded shortly thereafter.
2 . 3 The subject property is a rectangular shaped parcel, 20 . 078
hectares (49 . 6 acres) in size and is located approximately 200
metres (656 feet) east of Rundle Road and 1 kilometre ( . 62 miles)
north of Nash Road but is more formally described as Part Lot 22,
Concession 3, in the former Township of Darlington.
3 . PUBLIC NOTICE AND SUBMISSIONS
3 . 1 Pursuant to Council's resolution of July 26, 1982 and the
requirements of the Planning Act, the appropriate signage
acknowledging the application was installed on the subject lands.
In addition the appropriate notice was mailed to each landowner
within 121. 92 metres (400 feet) of the subject property as
required by the Planning Act.
3 .2 As a result .of the public notification process the Planning and
Development Department has received numerous telephone and
counter inquiries at which time concerns were expressed regarding
the nature of the application, the security of the building and
number of persons to be housed. In addition, the Planning and

Development Department has received two letters of objection from
.area residents who objected to the applications on environmental,
social and economic grounds .
4 . OFFICIAL PLAN CONFORMITY
4 . 1 Within both the existing Durham Regional Official Plan and the
recommended plan, the subject property is designated as Major
Open Space with an indication of Environmentally Sensitive Area
and Hazard Lands.
4 .2 Section 12 .2 . 2 of the existing Regional Official Plan states that
the predominant use of lands so designated shall be for
agricultural and farm related uses and other similar uses such as
reforestation, cemeteries, allotment gardens, nursery gardening,
golf courses, camp grounds, riding and boarding stables, dog
kennels, mink farms and fair grounds .
4 . 3 As the applicant is proposing to develop the subject property
with a Youth Detention Facility, the applicant has applied to
appropriately amend the Durham Regional Official Plan.
5 . ZONING BY-LAW COMPLIANCE
5 . 1 Within the Town of Newcastle Comprehensive Zoning By-law 84-63,
the subject property is zoned in part Agricultural (A) and in
part Environmental Protection (EP) . The current zone categories
do not permit the development of the subject property as proposed
and the applicant has therefore applied to amend the Town of
Newcastle Comprehensive Zoning By-law 84-63 .
6 . AGENCY COMMENTS
6 . 1 The application for Official Plan Amendment was circulated to
various agencies by the Durham Regional Planning Department.
Concurrently, the Town of Newcastle Planning and Development

undertook a circulation of the proposed zoning by-law amendment.
However, as the applications were only recently circulated, the
Planning and Development Department has not as yet received any
agency comments .
7 . STAFF COIMNTS
7 . 1 The applicant is seeking approval to amend both the Durham
Regional Official Plan and the Town of Newcastle Comprehensive
Zoning By-law in order to permit the development of a Youth
Detention Facility.
7 .2 Staff note that the Durham Regional Official Plan indicates that
a substantial portion of the subject property is an
Environmentally Sensitive Area. In addition, this sensitivity is
reflected in the Town of Newcastle Comprehensive Zoning By-law
84-63 which zones a substantial portion of the subject property
as Environmental Protection (EP) . Therefore, prior to the final
consideration of the application, the Planning and Development
Department will require the applicant to submit a detailed
environmental impact report for review and approval by the Town,
the Ministry.of Natural Resources and the local Conservation
Authority. Nevertheless, the Planning and Development Department
will continue to process the application in the usual manner
pending the receipt of all outstanding comments .
7 . 3 As the purpose of this report is to satisfy the requirements of
the Planning Act with respect to the Public Meeting and in
consideration of the outstanding comments, it would be in order
to have the application referred back to staff for further
processing and the preparation of a subsequent report.
