Date: NOVEMBER 8 1999 Res. # �- Report #: ADMIN.35 - 99 Subject: MAYOR AND COUNCILLORS' SALARY Recommendations: It is respectfully recommended that Council approve the following: 1. That Report ADMIN. 35 — 99 be received for information. REPORT: 1. Background: 1 .1 At the Council meeting held on October 25 1999, Councillor Young presented the following resolution: WHEREAS IN 1998 the Council of the Municipality of Clarington set the salary rates for the Mayor and Councillors of the Municipality; and WHEREAS the Councillors salary was set at 40% of the Mayor's salary; and WHEREAS the Mayor's salary for the year 2000 was set at $50,000 per annum; and WHEREAS the job rate for the Chief Administrative Officer of the Municipality of Clarington is set at $111,114 per annum; and WHEREAS the Mayor's salary is 45% of the Chief Administrative Officer's listed job rate: NOW THEREFORE BE IT RESOLVED THAT the Mayor's salary beginning in the 2001 be set at 45% of the Chief Administrative Officer's job rate; 2 AND THAT the Councillors' salary beginning in the year 2001 be set at 40% of the Mayor's salary". 1.2 Said resolution was tabled by Council for two weeks pending a functional policy report from the Chief Administrative Officer. 2. Comment: 2.1 By-Law 98-173 sets out the Mayor and Councillors' salary as follows: 1999 2000 Mayor $48,000 $50,000 Councillors $19,200 $20,000 The Councillors' salary as per the by-law is 40% of the Mayor's salary for both years 1999 and 2000. 2.2 The salary for the Chief Administrative Officer contains an eight step progression, ranging between $90,747 and $111,114 for year 1999 and between $93,106 and $114,003 for year 2000. The Mayor's salary, in relation to that of the Chief Administrative Officer, is as follows: 1999 2000 Chief Administrative Officer's job rate $111,114 $114,003 Mayor's salary $ 48,0000 $ 50,000 Mayor's salary Percentage of CAD's Job rate 43.2% 43.86% 2.3 Should Council desire to fix the salary for the Mayor and the Councillors commencing January 1 2001, in such a way as to tie in the Chief Administrative Officer with the Mayor and the Councillors' salary by percentage relationship, it would be appropriate to adopt the current percentage relationship, which means commencing January 1, 2001, the Councillors' salary will be 40% of the Mayor's salary, and the Mayor's salary will be 43.86% of the Chief Administrative Officer's job rate. 3 2.4 If approved, the rate of pay for the Mayor and the Councillors would change if there is a change in the job rate of the Chief Administrative Officer. In this regard, there is no increase in the Mayor's and Councillors' salary in 1999 or in 2000, as by-law 98-173 remains in effect. In January 2001, the staff, including the CAO will receive a 2.5% increase, resulting from the Collective Agreement negotiated with COPE, which when applying the current percentage relationship, will result in the following salary structure. 2001 CAO Job rate $116,854 Mayor's salary (43.86%) $ 51,252 Councillors' salary (40%) $ 20,500 2.5 The current Collective Agreement with CUPE expires at the end of 2001. Therefore, the job rate of the Chief Administrative Officer for year 2002 is unknown and the same applies to the Mayor and Councillors' salaries for year 2002 and onward. 2.6 Several Municipalities have tied the Mayor and Councillors' salary to that of the Chief Administrative Officer or subject themselves to the same increases as staff would get from collective agreement bargaining. The advantage of such an approach will remove future debate, and any candidate running for public office would know how the salary is determined. On the other hand, the role and responsibilities of the elected officials may change over time. Given this possibility, the percentage method may not accurately reflect the actual value of work performed. Therefore, the percentage approach should not be viewed as a long term fix. It is also important to note that, notwithstanding any good intention of any Member of Council to fix the salary structure for future Council, there is absolutely no guarantee that future Council would adhere to such policy. In this regard, Council may consider to take a do nothing approach and let the future Council determine the appropriate method to develop a salary structure for year 2001 and beyond.
