THAT Report PD-163-91 be received; 2 . THAT the Town of Newcastle Comprehensive Zoning By-law 84- 63, be amended, to bring the zoning by-law into conformity with the Town of Newcastle Official Plan by requiring the minimum lot area for new lots in the 'Residential Hamlet (RH) ' zone to be increased from 3,000 sq. metres to 4,000 sq. metres; 3. THAT the amending by-law attached hereto be forwarded to Council for approval; and 4 . THAT any delegation be advised of Council's decision. 1. APPLICATION DETAILS 1. 1 Applicant: Corporation of the Town of Newcastle 1.2 Rezoning: Amendment to the Town of Newcastle Comprehensive Zoning By-law 84-63, to require the minimum lot area for new lots in the 'Residential Hamlet (RH) ' zone to be increased from 3,000 sq. metres to 4,000 sq. metres thereby bringing the zoning by-law into conformity with the Town of Newcastle Official Plan. 5 > 6 °-CL r4irs is rnrtn Eo oti nECVC�o rnrEn REPORT NO. : PD-163-91 PAGE 2 1. 3 Land Affected: All new lots created in the 'Residential Hamlet (RH) ' zone throughout the Town of Newcastle. 2. BACKGROUND 2 . 1 On May 31, 1991, Town Council approved Recommendation #GPA- 322-91 which authorized staff to advertise in local newspapers a Public Meeting to be held July 22, 1991 in relation to the proposed Zoning By-law Amendment. A public notice advising the general public of the date and time of the Public Meeting appeared in the Wednesday, June 19, 1991 editions of the Oshawa Times, the Canadian Statesman, and the Orono Weekly Times . Public Notice was given only by means of local newspapers since the implications of the zoning by-law amendment are town-wide in nature, ie. affect numerous areas of the Town. To date, no inquiries have been made concerning the zoning by-law amendment. 3. BY-LAW PROVISIONS 3 . 1 Currently, the Town of Newcastle Comprehensive Zoning By- law 84-63, Section 9, Residential Hamlet (RH) Zone, Subsection 9 .2, Regulations for Residential Uses, states that the minimum lot area is 3,000 sq. metres . However, the Town of Newcastle Official Plan, Section 9, Hamlets, Subsection 9 .4, Residential Development viii) states that the "minimum lot size for new residential lots in Hamlets with or without municipal water systems shall be 0. 4 hectares . . . " or 4,000 sq. metres . The purpose of the zoning by-law amendment is to make the zoning by-law conform to the policies of the Official Plan because the zoning by-law legally implements the Official Plan. In order to do this it is proposed that Subsection 9 . 2 a) be amended from: "Lot Area (minimum) 3,000 sq. r_.. REPORT NO. : PD-163-91 PAGE 3 metres to: "Lot Area (minimum) 4,000 sq. metres" . 4. COMMENTS AND CONCLUSION 4 . 1 The proposed amendment to the zoning by-law does not affect existing lots of record. Under the provisions of the by- law these lots will still be eligible for building permits provided the usual requirements of the Durham Regional Health Department can be satisfied. 4 .2 The purpose of the zoning by-law is to legally implement the policies of the Town Official Plan. Since, the zoning by- law must conform to the policies of the Town Official Plan, this zoning by-law amendment will correct a technical inconsistency between the Town's Official Plan and the Town's Comprehensive Zoning By-law. Kotseff Director of Planning Chief A nistrative and Development Officer BR*DC*FW*df *Attach 11 July 1991 f.f ff3(.1 THE CORPORATION OF THE TOWN OF NEWCASTLE BY-LAW NUMBER 91- . being a By-law to amend By-law 84-63, the Comprehensive Zoning By- law for the Corporation of the Town of Newcastle WHEREAS the Council of the Corporation of the Town of Newcastle deems it advisable to amend By-law 84-63, as amended, of the Corporation of the Town of Newcastle to increase the minimum lot size requirement to bring it into conformity with the Town of Newcastle Official Plan. NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the Town of Newcastle enacts as follows: 1. Section 9.2 a) is hereby amended by changing the number 3,000 to 4,000 as follows: "Lot Area (minimum) 3,000 square metres" to "Lot Area (minimum) 4,000 square metres". 2. This By-law shall come into effect on the date of passing hereof, subject to the provisions of Section 34 of the Planning Act. BY-LAW read a first time this day of 1991.
