Subject: REMOVAL OF "HOLDING (H) " SYMBOL TO IMPLEMENT PLAN OF SUBDIVISION
APPLICANT: WEST BOWMANVILLE DEVELOPMENTS LTD.
PART LOT 15 & 16, CONCESSION 2, FORMER TOWN OF BOWMANVILLE

Recommendations:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. THAT Report PD-156 -91 be received;
2 . THAT Rezoning Application submitted by West Bowmanville
Developments Limited requesting the removal of the "Holding (HI 11
symbol from the subject lands within Draft Plan of Subdivision 18T'-
88046 being Part of Lots 15 and 16, Concession 2, former Township
of Darlington for Phase I be approved and the By-law attached
hereto be forwarded to Council for approval;
3. THAT any delegation and those persons listed in this report be
advised of Council 's decision; and
4 . THAT a copy of this report and the amending by-law be forwarded to
the Region of Durham Planning Department.
1. BACKGROUND
1. 1 Council at their May 14, 1990 meeting approved By-law 90-83 thereby
rezoning the subject lands within Draft Plan of Subdivision 18T-
88046 to the appropriate residential and commercial zones with a
Holding (H) symbol prefix added.
2. The subject lands through Plan of Subdivision 18T-88046 received
draft approval on February 21, 1991.

2. STAFF COMMENTS
2 . 1 Within the Town of Newcastle Comprehensive Zoning By-law 84-63,
Section 3 . 9 requires that prior to the removal of the "Holding (H) "
symbol, Council is to be satisfied that the uses to be permitted
will be adequately serviced, the lands to be used have adequate
access, prior uses of the lands will not prevent the use of the
lands for purposes intended by the By-law, and that the necessary
agreements in respect of such matters and the associated financial
requirements, where required, have been executed. The Subdivision
agreement between the Town of Newcastle and the Owner is being
completed at this time for execution and registration.
2 .2 The Region of Durham Planning Department has confirmed that the
necessary agreements are in place and would have no objection to
the removal of the "Holding (H) " symbol.
2 . 3 Staff are now in a position to recommend that the "Holding (H) "
symbol, insofar as it effects Phase 1 development, be lifted;
insomuch as the condition of draft approval, requested as
conditions of the Town's approval, have been included through the
Subdivision Agreement. Staff would confirm that the attached by-
law reflects Phase I only.
2 .4 It is noted for the Committee's information that the Holding symbol
has not been removed as it pertains to the (C2) Neighbourhood
Commercial Blocks within Phase I (Blocks 108 and 109) at this time.
Their removal will be considered at such time that a site plan
application is submitted for approval.

BY-LAW NUMBER 91-
being a By-law to amend By-law 84-63, the Comprehensive Zoning
By-law for the Corporation of the Town of Newcastle
WHEREAS the Council of the Corporation of the Town of Newcastle
deems it advisable to amend By-law 84-63, as amended, of the
Corporation of the Town of Newcastle in accordance with
application DEV 88-30 to permit the development of Phase I of
Plan of Subdivision 13T-88046;
NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation
of the Town of Newcastle enacts as follows:
1. Schedule 113" to By-law 84-13 as amended, is hereby further
amended by changing the 7,)ne designation from:
"Holding - Urban Residential Type One ((H)R1)," to "Urban
Residential Type One (R1) ".
"Holding - Urban Residential Type Two ((H)R1) " to "Urban
Residential Type Two (R2) ".
"Holding - Urban Residential Type Three ((H)R3) " to "Urban
Residential Type Three (R3) ".
2. Schedule "A" attached hereto shall form part of this By-
law.
3. This By-law shall come into effect on the date of the
passing hereof, subject to the provisions of Section 35 of
the Planning Act.

PURPOSE AND EFFECT
BY-LAW 91- /69'
The purpose and effect of By-law 91- /08 is to amend Zoning By-
law 84-63, as amended of the Town of Newcastle by changing the
zone category of the lands identified by Schedule "A" hereto
from:
"Holding - Urban Residential Type One ( (H)R1) " to "Urban
Residential Type One (R1) " .
"Holding - Urban Residential Type Two ( (H)R2) " to "Urban
Residential Type Two (R2) " .
"Holding - Urban Residential Type -Three ( (H)R3) " to "Urban
Residential Type Three (R3) " .
The subject By-law will implement draft plan of subdivision 18T-
88046 (Phase 1) and permit the development of 54 single family
dwelling units, (78) semi-detached units, (80) townhouse units
and a park block.
