THAT Report PD-154-91 be received; 2 . THAT Rezoning Application DEV 91-013 submitted by 812746 Ontario Limited c/o Doug Farrow to permit the development of four (4) semi-detached/linked dwelling units be Approved; and 3 . THAT the amending by-law attached hereto be forwarded to Council for approval; 4 . THAT a copy of this report and the amending by-law be forwarded to the Region of Durham Planning Department; 5. THAT the amending by-law be circulated in accordance with regulations made under the Planning Act; 6 . THAT the "H" - Holding Symbol in the amending by-law be removed at such time as the applicant has received the approval and fulfilled the requirements of Land Division Committee; 7 . THAT the Durham Region Planning Department, and all interested parties listed in this report and any delegation be advised of Council's decision. 1. PD- 154-91 PAGE 2 2 . LOCATION 2 . 1 The subject property is located in Part of Lot 9, Concession 2 in the former Town of Bowmanville. More specifically, the property's municipal address is 10 Mann Street in Bowmanville. 3 BACKGROUND 3. 1 On April 2, 1991, the Town of Newcastle Planning Department received an application to amend the Town of Newcastle Comprehensive Zoning By-law 84-63 to permit the development of four (4) semi-detached residential units . 4 EXISTING AND SURROUNDING USES 4 . 1 Existing Uses : residential dwelling 4 . 2 Surrounding Uses : East - Existing Residential and an application for a residential subdivision ( 18T88024) West - Approved Plan of Subdivision ( 10M 829) South - existing residential North - Approved Plans of Subdivisions (10M 829 and 10M 830) 5 OFFICIAL PLAN POLICIES 5 . 1 Both the Durham Region Official Plan and the Town of Newcastle Official Plan designate the subject land as "Residential" . This proposal to permit residential development complies with the policies of the Residential designation of both Official Plans . 6 ZONING BY-LAW PROVISIONS 6 . 1 According to the Town of Newcastle Comprehensive Zoning By-law 84-63, as amended, the subject site is zoned "Agricultural (A) " . Rezoning of this property is necessary to permit the proposed development. 7 PUBLIC MEETING AND SUBMISSION 7 . 1 Pursuant to Council's Resolution of July 26, 1982 and the . . . .3 REPORT NO. PD- 154-91 PAGE 3 requirements of the Planning Act the appropriate signage acknowledging the application was installed on the subject lands. In addition, the appropriate notice was mailed to each landowner within the prescribed distance. 7 .2 A Public Meeting was held on May 21, 1991 at which time this application was brought forward for public comment. Two residents spoke at this meeting noting their preference for link dwellings rather than semi-detached dwellings . It is noted that the provisions for yard setbacks and frontages for semi-detached and link dwellings are the same in the Town of Newcastle Comprehensive Zoning By-law 84-63, as amended. 8 AGENCY COMMENTS 8 . 1 In accordance with departmental procedures, the application was circulated to obtain comments from other departments and agencies . The following departments/agencies in providing comments, offered no objection to the application as filed: Town of Newcastle Fire Department Newcastle Hydro-Electric Commission Peterborough Victoria Northumberland and Newcastle Roman Catholic School Board Northumberland Newcastle Public School Board Central Lake Ontario Conservation Authority Durham Region Planning Department 8 .2 The following agencies had specific requirements which can be imposed as conditions of approval at the time severance application is filed. i) The Ministry of Natural Resources noted that these land are located in the West Branch of the Soper Creek Master Drainage Plan. It is important that the requirements of the Master Drainage Plan are met and the Ministry may request the placement of conditions on the subsequent severance applications . . . . .4 � 0 REPORT NO. PD-154-91 PAGE 4 ii) The Town of Newcastle Community Services Department have requested to receive 5% cash-in-lieu of parkland to be dedicated to the Parks Reserve Account. iii) The Town of Newcastle Public Works Department have requested the following: that the applicant will bear the costs of any works on Mann Street which are necessitated as a result of this development; that the applicant contribute to the cost of reconstructing Mann Street; that the applicant provides a Lot Grading Plan; that property access is applied for; and that the applicant satisfies the Public Works Department financially and otherwise. iv) The Durham Region Works Department have requested that Regional Levies be paid as a condition of consent. 9 STAFF COMMENTS 9 . 1 Staff note that there exists a single family dwelling on the site. The applicant has indicated that this dwelling will be removed prior to the construction of the proposed dwellings . A demolition permit will be required for the removal of the dwelling unit at such time. 9 .2 It is apparent that the surrounding lands are presently undergoing residential development. Link dwellings are being built on the newly created lots to the west of the subject site, and semi-detached/link dwellings are proposed to the north of the subject lands . 10 CONCLUSION 10. 1 It is recommended that this application be APPROVED and the "Holding" symbol will be removed when the conditions of severance have been met. . . . .5 REPORT NO. I.P. , Clerk From: Heather Moulton, Planner, Development Review Branch Date: 25 June 1991 PURPOSE AND EFFECT: BY-LAW 91- Subject: FILE: DEV 91-013 The purpose and effect of By-law 91- is to amend Zoning By- law 84-63, as amended of the Town of Newcastle by changing the zone designation of the lands identified by Schedule "A" hereto from: "Agricultural (A) " to "Holding - Urban Residential Type One ( (H)Rl) " ; The subject By-law would permit the development of 4 semi- detached or linked dwelling units . Heather l THE CORPORATION OF THE TOWN OF NEWCASTLE BY-LAW NUMBER 91 being a By-law to amend By-law 84-63, the Comprehensive Zoning By-law for the Corporation of the Town of Newcastle. WHEREAS the Council of the Corporation of the Town of Newcastle deems it advisable to amend By-law 84-63, as amended, of the Corporation of the Town of Newcastle to implement Application Dev 91-013. NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the Town of Newcastle enacts as follows: 1. Section 12.4 "Special Exception- Urban Residential Type One (Rl)" zone is hereby amended by adding thereto the Special Exception 12,4.31 as follows: "12.4.31 Notwithstanding Section 12.1, only a semi-detached dwelling may be permitted on those lands zoned R1-31 on the Schedules to this by-law. The placement of buildings and structures shall be subject to the zone regulations as set out in Section 12.2. For the purposes of this provision, a semi-detached dwelling shall mean a building separated vertically into two separate dwelling units, connected underground by footing and foundation, each of which has an independent entrance directly from the outside of the building and each of which is located on a separate lot." 2. Schedule"3" to By-law 84-63 as amended, is hereby further amended by changing the zone designation on the land identified in Schedule"A" from: "Agricultural (A)"to"Holding - Urban Residential Exception ((H)RI-31)" 3. Schedule "A" attached hereto shall form part of this By-law. 4. This By-law shall come into effect on the date of the passing hereof, subject to the provisions of Section 34 of the Planning Act.
