PIPE CROSSING AGREEMENT WITH THE CANADIAN PACIFIC RAILWAY
AND A CONSTRUCTION AND MAINTENANCE AGREEMENT WITH
829426 ONTARIO INC.
REMOVAL OF "HOLDING (H) " SYMBOL
Recommendations:
It is respectfully recommended to the General Purpose and
Administration Committee that Council approve the following:
1. THAT Report PD-148-91 be received;
2 . THAT the attached by-law authorizing the execution of a Pipe
Crossing Agreement between the Canadian Pacific Railway and
the Corporation of the Town of Newcastle be approved and
that the Mayor and Clerk be authorized to execute this
agreement at such time as it has been prepared to the
satisfaction of the Director of Public Works, be APPROVED;
3 . THAT the attached by-law, authorizing the execution of a
Servicing Agreement between 829426 Ontario Inc . and the
Corporation of the Town of Newcastle be approved and that
the Mayor and Clerk be authorized to execute this agreement
at such time as it has been prepared to the satisfaction of
the Director of Public Works, be APPROVED; and
4 . THAT the attached by-law removing the "Holding (H) " symbol
on the subject land be APPROVED.
REPORT:
1. The subject property is a 2 .299 ha parcel located on the
south side of Highway No. 2, approximately midway between
Green Road and Regional Road No. 57 (see Attachment No. 1) .
In March 1990, Council passed a zoning by-law amendment
permitting the site to be developed for commercial uses to
accommodate a Canadian Tire Store and gas bar.

2 . Subsequent to the zoning by-law amendment, the applicant has
submitted for site plan approval. In conjunction with the
consideration for site plan approval, road construction and
storm water drainage works are required to be addressed
through an agreement with the applicant.
3. In addition, since the proposed storm water drainage works
requires crossing of the Canadian Pacific Railway, C.P.R.
requires that the Town enter into a Pipe Crossing Agreement
to deal with the construction and future maintenance of the .
proposed storm water drainage works .
4 . The subject property is currently zoned "Holding - General
Commercial Exception ( (H)C7-1) " . The " (H) Holding" symbol
will have to be removed to allow development to proceed.
Subject to the applicant meeting the requirements of the
Ministry of Transportation and the Town of Newcastle, site
plan approval will be finalized to permit the development to
proceed.

BY-LAW NO. 91-
being a by-law to authorize the execution of
a Pipe Crossing Agreement between the
Canadian Pacific Railways and the Corporation
of the Town of Newcastle.
WHEREAS the Council of the Town of Newcastle deems it necessary
to pass a by-law to address the request of the Canadian Pacific
Railways for a Pipe Crossing Agreement to facilitate the proposed
development north of the Canadian Pacific Rail line in Part of
Lots 15 and 16, Concession 1, former Township of Darlington.
NOW THEREFORE the Council of the Corporation of the Town of
Newcastle hereby enacts as follows:
1. That the Mayor and Clerk are hereby authorized to execute on
behalf of the Corporation of the Town of Newcastle, and seal
with the Corporation's seal, an agreement between the
Canadian Pacific Railways and the Corporation of the Town of
Newcastle.

BY-LAW NUMBER 91-
being a By-law to authorize the entering into of a Servicing
Agreement with 829426 ONTARIO INC. and the Corporation of the Town
of Newcastle.
WHEREAS the Council of the Town of Newcastle deem it necessary to
require a Servicing Agreement in the consideration of a development
proposal of a Canadian Tire Store located in Part of Lots 15 and
16, Concession 1, former Township of Darlington.
NOW THEREFORE the Council of the Corporation of the Town of
Newcastle hereby enacts as follows:
1. THAT the Mayor and Clerk are hereby authorized to execute on
behalf of the Corporation of the Town of Newcastle, and seal with
the Corporation's seal, an Agreement between 829426 ONTARIO INC:
and the said Corporation.

THE CORPORATION OF THE TOWN OF NEWCASTLE
BY-LAW NUMBER 91-
being a By-law to amend By-law 84-63, the Comprehensive Zoning By-law
for the Corporation of the Town of Newcastle.
WHEREAS the Council of the Corporation of the Town of Newcastle deems
it advisable to amend By-law 84-63, as amended, of the Corporation of
the Town of Newcastle in accordance with application DEV 90-77 to permit
the construction of a commercial structure.
NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the
Town of Newcastle enacts as follows:
1. Schedule 113" to By-law 84-63 as amended, is hereby further amended
by changing the zone designation from:
"Holding - General Commercial Exception ( (H)C1-7) " to "General
Commercial Exception (C1-7) "
2. Schedule "A" attached hereto shall form part of this By-law.

3. This By-law shall come into effect on the date of the passing
hereof, subject to the provisions of Section 35 of the Planning Act.
