It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. THAT Report PD- 131 -91 be received;
2. THAT the attached By -law to amend the Town of Newcastle Sign By-
law 76 -25, as amended, be APPROVED.
1. BACKGROUND
1.1 In the past there have been a number of applications for sign
permits to erect illuminated signs less than 5 feet above the
finished grade.
1.2 The Sign By -law 76 -25 in Section 4(3)(c) provides: -
"No illuminated sign shall be less than 5 feet above
the finished grade"
1.3 Applications not in compliance with this requirement can be dealt
with a) through site specific amendment to the Sign By -law which
results in a processing delay b) withdrawal of the application
or c) increasing sign height to meet the 5 foot requirement, which
perhaps results in a less aesthetically pleasing sign being
erected.
1.4 Other than a possible obstruction or distraction to motorists,
there is no apparent reason for this requirement. This provision
applies only to illuminated signs.

2. RECOMMENDATION
2.1 In consideration of the above and to process applications more
efficiently, Staff recommend approval of the attached By -law
deleting Section 4 (3)(c).

THE CORPORATION OF THE TOWN OF NEWCASTLE
BY -LAW NUMBER 91-
being a By -law to amend By -law 76 -25, as amended, being the Town
of Newcastle Comprehensive Sign By -law.
WHEREAS the Municipal Act provides that Council of a municipal
Corporation may pass by -laws for prohibiting or regulating signs,
or other advertising devices.
AND WHEREAS the Council of the Corporation of the Town of
Newcastle deems it advisable to amend By -law 76 -25, as amended.
NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation
of the Town of Newcastle enacts as follows:
1. Section 4, Subsection 3(c) of By -law 76 -25, as amended, is
hereby repealed.
2. This By -law shall come into effect on the date of the
passing hereof.
BY -LAW read a first time this day of
1991.
BY -LAW read a second time this day of
1991.
BY -LAW read a third time and finally passed this
day of 1991.
