Subject: MONITORING OF THE DECISIONS OF THE COMMITTEE OF ADJUSTMENT
FOR THE MEETING OF MAY 23, 1991

Rey t�eniisticnrespectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. THAT Report PD-126-91 be received; and
2 . THAT Council concur with the decisions of the Committee of
Adjustment made at its meeting of May 22, 1991; and
3 . THAT Staff be authorized to appear before the Ontario Municipal
Board to defend the decisions of the Committee of Adjustment in the
event of an appeal.
1 The Committee of Adjustment heard applications on May 23, 1991.
The Committee dealt with a total of three (3) applications during
the meeting. Applications A 91/014 and A 91/015 were TABLED by the
Committee to the next available meeting date. Applications A
91/012 was APPROVED with modification.
2 Staff in providing comments to the Committee did not support
application A 91/012 . The applicant proposes to create a new lot
which is surplus to the farm operation through a related
application LD 42/91. The applicant proposed to retain storage
sheds totalling 591 . 3 m2 (6365 sq. ft. ) which exceeded the maximum
allowable 40% of the total floor area of the main dwelling 213 .3
m (2297 sq. ft. ) .
3 The Committee in their deliberation agreed to grant a variance for
one storage shed totalling 2365 sq. ft. (219 7 mz) or approximately
103% the size of the dwelling. The balance of the accessory
structures are all to be removed prior to final Town approval of

the related land severance application LD 42/91. Staff have
reviewed this decision and are supportive of the Committee's
action.
4 The other two applications were both TABLED to the next available
meeting. Application A 91/014 was filed and circulated with an
incorrect legal description, therefore in order to provide
neighbouring residents proper opportunity to comment, it was
determined a re-circulation should take place. Comments from the
Durham Health Department on application A 91/015 were received late
the day of the hearing. The comments advised of an objection to
the proposal, due to insufficient information. Committee deemed
it appropriate to TABLE the matter to allow the applicant to
clarify the Health Department's concerns .
5 Staff have reviewed the decisions of the Committee and are
satisfied that the decisions conform to the general intent of the
Official Plan and the Zoning By-law and that the variances sought
are minor in nature.
6 Council 's concurrence with the Committee of Adjustment decisions
is required in order to afford Staff's official status before the
Ontario Municipal Board in the event of appeal of the decisions of
the Committee of Adjustment.
