CHECCHIA PART LOT 35, CONCESSION 3, FORMER TOWNSHIP OF DARLINGTON FILE: DEV 91-015 Recommendations: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PD-122-91 be received; 2 . THAT application to amend the Town of Newcastle Comprehensive Zoning By-law 84-63, as amended, submitted by David Thomas on behalf of Mr. & Mrs. Checchia be referred back to Staff for further processing and the preparation of a subsequent report upon receipt of all outstanding comments; and 3 . THAT the Durham Region Planning Department, and all interested parties listed in this report and any delegation be advised of Council's decision. 1. APPLICATION DETAILS 1. 1 Applicant: David Thomas 1. 2 Owner: Mr. & Mrs . Checchia 1. 3 Rezoning: From Urban Residential Exception (R1-19 ) to a zone appropriate to permit the creation of a maximum of three residential lots with a minimum frontage of 13 . 7 m (45 feet) per lot. 1.4 Area: 0 . 37 ha (0 . 9 acres) 2. LOCATION 2 . 1 The subject lands are located in Part of Lot 35, Concession 3, former Township of Darlington, with the municipal address being 233 Townline Road N. (Regional Road 55) . PD- 122-91 PAGE 2 3 BACKGROUND 3 . 1 On April 11, 1991 the Planning Department received an application to amend the Town of Newcastle Comprehensive Zoning By-law 84- 63, as amended, to permit the creation of a maximum of three residential lots having a minimum frontage of 13 . 7 m (45 feet) each. 3 .2 Staff note that Mr. & Mrs . Checchia made application to rezone these lands in 1987 to permit the creation of one ( 1) additional residential lot. This application was approved and a By-law (88- 057) was passed. Subsequently, an application to sever the property was made, however, the consent was never cleared as the conditions of severance had not been met within the allotted time period. 4 EXISTING AND SURROUNDING USES 4 . 1 Existing Uses : Existing Single Dwelling Unit 4 .2 Surrounding Uses: East - Application for Residential Subdivision 38 Single Dwelling Units ( 18T 89115) West - vacant South - Existing Single Dwelling Units North - Existing Single Dwelling Units 5 OFFICIAL PLAN POLICIES 5 . 1 According to the Durham Region Official Plan, the subject site is located within the Courtice Major Urban Area, and appears to be designated "Major Open Space" . The precise extent and limit of the Major Open Space will be determined through comments from the Central Lake Ontario Conservation Authority. 5 .2 As depicted on Schedule 6 . 1 of the Town of Newcastle Official Plan, the lands are situated within a "Residential" designation. � (� 2 . . 3 REPORT NO. PD- 122-91 PAGE 3 Lands so designated shall be used for predominantly residential purposes . 6 ZONING BY-LAW PROVISIONS 6 . 1 The subject site is zoned "Urban Residential Exception (R1-19) " . This zone permits residential development on a lot with minimum lot area of 1700 square metres . 7 PUBLIC MEETING AND SUBMISSION 7 . 1 Pursuant to Council 's Resolution of July 26, 1982 and the requirements of the Planning Act the appropriate signage acknowledging the application was installed on the subject lands. In addition, the appropriate notice was mailed to each landowner within the prescribed distance. 8 AGENCY COMMENTS 8 . 1 In accordance with departmental procedures, the application was circulated to obtain comments from other departments and agencies . The following departments/agencies in providing comments, offered no objection to the application as filed: Town of Newcastle Fire Department Peterborough Victoria Northumberland & Newcastle Roman Catholic Separate School Board Ministry of Natural Resources 8 .2 The Town of Newcastle Public Works Department had no objection to the application. However, detailed comments will be made upon the submission of a consent application. 8 . 3 The Durham Region Health Department objects to this application as the proposed lots will be insufficient in size to accommodate private sewage disposal. r- 7 . . . .4 REPORT NO. PD- 122-91 PAGE 4 8 .4 Comments have yet to be received from the following agencies : Town of Newcastle Community Services Central Lake Ontario Conservation Authority Durham Region Planning Department Durham Region Works Department Northumberland and Newcastle Board of Education City of Oshawa Ontario Hydro 9 CONCLUSION 9 . 1 As the purpose of this report is to address the requirements of a Public meeting under the Planning Act, and in consideration of the comments outstanding, Staff recommend that the application be referred back to Staff for further processing.
