MONITORING OF THE DECISIONS OF THE COMMITTEE OF ADJUSTMENT
FOR THE MEETING OF MAY 9, 1991

Recommendations:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. THAT Report PD-120-91 be received; and
2 . THAT Council concur with the decisions of the Committee of
Adjustment made at its meeting of May 9, 1991; and
3 . THAT Staff be authorized to appear before the Ontario Municipal
Board to defend the decisions of the Committee of Adjustment in the
event of an appeal.
1 The Committee of Adjustment heard applications on May 9, 1991. The
Committee dealt with a total of four (4) applications during the
meeting. Applications A 91/012 was TABLED by the Committee to the
next available meeting date. The balance of the applications were
APPROVED.
2 Staff in providing comments to the Committee did not support
application A 91/011. The applicant proposes to construct a garage
having a floor area of 107 m2 ( 1152 sq. ft. ) . This exceeded the
40% of the total floor area of the dwelling, which equals the
allowable floor area of an accessory structure by 37 m2 (396 sq.
ft. ) . In commenting to the Committee of Adjustment, Staff
recommended the garage be scaled down in size and therefore did not
support the application.

3 The applicant advised the Committee that the proposed garage is
pre-fabricated and therefore difficult to be reduced in size. Two
neighbouring residents appeared at the meeting concerned that the
garage would become a body shop thus creating a noise problem.
4 The Committee of Adjustment approved the application as applied
for. Although Staff did not support application, appeal to the
Ontario Municipal Board is not recommended given the Staff time
and legal costs involved with a board hearing.
5 Staff have reviewed the balance of the decisions of the Committee
and are satisfied that the decisions conform to the general intent
of the Official Plan and the Zoning By-law and that the variances
sought are minor in nature.
6 Council's concurrence with the Committee of Adjustment decisions
is required in order to afford Staff's official status before the
Ontario Municipal Board in the event of appeal of the decisions of
the Committee of Adjustment save and except for A 91/011 .
