Subject: REZONING APPLICATION - MCDONALD/FARROW
PART LOT 9, CONCESSION 2, TOWN OF BOWMANVILLE - 10 MANN STREET

Recommendations:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. THAT Report PD-113-91 be received;
2 . THAT application to amend the Town of Newcastle
Comprehensive Zoning By-law 84-63, as amended, submitted by
812746 c/o Doug Farrow on behalf of Dorothy McDonald to
permit four (4) semi-detached units be referred back to
Staff for further processing and the preparation of a
subsequent report upon receipt of all outstanding comments;
and
3. THAT the Durham Region Planning Department, and all
interested parties listed in this report and any delegation
be advised of Council's decision.

1. 1 Applicant: 812746 Ontario Limited c/o Doug Farrow
1. 2 Owner: Dorothy McDonald
1. 3 Rezoning: From Agricultural (A) to a zone appropriate to
permit four (4) semi-detached units .
1.4 Area: 0 .26 ha ( 0. 64 ac)
2 . LOCATION
2 . 1 The subject property is located in Part of Lot 9, Concession 2 in
the former Town of Bowmanville. More specifically, the
property's municipal address is 10 Mann Street in Bowmanville.

3 BACKGROUND
3 . 1 On April 2, 1991, the Town of Newcastle Planning Department
received an application to amend the Town of Newcastle
Comprehensive Zoning By-law 84-63 to permit the development of
four (4) semi-detached residential units .
4 EXISTING AND SURROUNDING USES
4 . 1 Existing Uses: residential dwelling
4 .2 Surrounding Uses:
East: Existing Residential and an application for a
residential subdivision ( 18T88024)
West: Approved Plan of Subdivision ( 10M 829)
South: existing residential
North: Approved Plans of Subdivisions ( 10M 829 & 10M830)
5 OFFICIAL PLAN POLICIES
5 . 1 Both the Durham Region Official Plan and the Town of Newcastle
Official Plan designate the subject land as "Residential " . This
proposal to permit residential development complies with the
policies of the Residential designation of both Official Plans .
6 ZONING BY-LAW PROVISIONS
6 . 1 According to the Town of Newcastle Comprehensive Zoning By-law
84-63, as amended, the subject site is zoned "Agricultural (A) " .
Rezoning of this property is necessary to permit the proposed
development.
7 PUBLIC MEETING AND SUBMISSION
7 . 1 Pursuant to Council 's Resolution of July 26, 1982 and the
requirements of the Planning Act the appropriate signage
acknowledging the application was installed on the subject lands.
In addition, the appropriate notice was mailed to each landowner
within the prescribed distance.

8 AGENCY COMMENTS
8 . 1 In accordance with departmental procedures, the application was
circulated to obtain comments from other departments and
agencies . The following departments/agencies in providing
comments, offered no objection to the application as filed:
Town of Newcastle Fire Department
Newcastle Hydro-Electric Commision
Peterborough Victoria Northumberland and Newcastle Roman
Catholic School Board
8 .2 The Ministry of Natural Resources noted that these land are
located in the West Branch of the Soper Creek Master Drainage
Plan. It is important that the requirements of the Master
Drainage Plan are met and the Ministry may request the placement
of conditions on the subsequent severance applications .
8 . 3 Comments have yet to be received from the following agencies:
Town of Newcastle Public Works Department
Town of Newcastle Community Services Department
Central Lake Ontario Conservation Authority
Northumberland and Newcastle Public School Board
Durham Region Planning Department
Durham Region Works Department
9 STAFF COMMENTS
9 . 1 Staff note that there exists a single family dwelling on the
site. The applicant has indicated that this dwelling will be
removed prior to the construction of the proposed dwellings .
9 .2 It is apparent that the surrounding lands are presently
undergoing residential development. Link dwellings are being
built on the newly created lots to the west of the subject site,
and semi-detached/link dwellings are proposed to the north of the
subject lands .

10 CONCLUSION
10. 1 It is recommended that this application be referred back to
Staff until such time as all comments from those agencies
circulated have been received.
