SERNAS ON BEHALF OF 715982 & 727114 ONTARIO LIMITED PART LOT 30, CONCESSION 3, FORMER TOWNSHIP OF DARLINGTON FILE: DEV 91-009 Recommendations: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PD- 10&91 be received; 2 . THAT application to amend the Town of Newcastle Comprehensive Zoning By-law 84-63, as amended, submitted by G.M. Sernas and Associates on behalf of 715982 & 727114 Ontario Limited be referred back to Staff for further processing and the preparation of a subsequent report upon receipt of all outstanding comments; and 3 . THAT the Durham Region Planning Department, and all interested parties listed in this report and any delegation be advised of Council's decision. 1 . APPLICATION DETAILS 1. 1 Applicant: G.M. Sernas and Associates 1 .2 Owner: 715982 & 727114 Ontario Limited 1.3 Rezoning: From - Agricultural (A) To - Holding - Urban Residential Type Three ( (H) R3) 1.4 Area: 0 .27ha (0 . 68 ac) 2 . LOCATION 2 . 1 The subject site is located in Part of L P t, 30, Concession 3, former Township of Darlington. More specifically, the lands are situated in the eastern most part of a Draft Approved Plan of Subdivision, being 18T 88067 (Attachment #3) . 3 BACKGROUND 3 . 1 On March 14, 1991, the Planning Department was notified that I' r';r'; ; . . . .2 REPORT NO. PD-106-91 PAGE 2 changes to Draft Plan of Subdivision 18T 88067 were requested (Attachment #2) . This change involves reducing the length of the proposed street which will now end as a cul-de-sac and hence resulting in a relotting of the eastern-most lots . The land which was previously shown as a street is now proposed for residential development and is subject to rezoning from "Agricultural" to "Urban Residential Type 3 - Holding ( (H)R3) " . It is noted that there is no increase in residential units as resulted from the roadway change and lot reconfiguration. 4 EXISTING AND SURROUNDING USES 4 . 1 Existing Uses : vacant, proposed residential development ( 18T 88067 ) 4 .2 Surrounding Uses: East - vacant, proposed residential development ( 18T77028) West - vacant, proposed residential development ( 18T88067) South - vacant North - vacant, proposed residential development ( 18T91006) 5 OFFICIAL PLAN POLICIES 5 . 1 According to both the Durham Region Official Plan and the Town of Newcastle Official Plan, the subject lands are designated "Residential" . 5 .2 The Courtice North Neighbourhood 3B Plan shows that the lands are designated "Residential - Medium Density, maximum 38 units per net hectare" . The proposed relotting does not increase the total number of units within Draft Approved Subdivision 18T 88067, hence not impacting the overall density of the lands . 6 ZONING BY-LAW PROVISIONS 6 . 1 The subject lands are zoned "Agricultural (A) " , necessitating a rezoning of the lands to permit the proposed road realignment and relotting 3 i i REPORT NO. PD-106-91 PAGE 3 7 PUBLIC MEETING AND SUBMISSION 7 . 1 Pursuant to Council 's Resolution of July 26 , 1982 and the requirements of the Planning Act the appropriate signage acknowledging the application was installed on the subject lands. In addition, the appropriate notice was mailed to each landowner within the prescribed distance. 8 AGENCY COMMENTS 8 . 1 In accordance with departmental procedures, the application was circulated to obtain comments from other departments and agencies . The following departments/agencies in providing comments, offered no objection to the application as filed: The Town of Newcastle Fire Department Northumberland and Newcastle Board of Education 8 .2 Comments have yet to be received from the following agencies: Town of Newcastle Public Works Department Town of Newcastle Community Services Department Central Lake Ontario Conservation Authority Peterborough Victoria Northumberland and Newcastle Roman Catholic Separate School Board Durham Region Planning Department Ministry of Natural Resources 9 STAFF COMMENTS 9 . 1 This application is the result of a request by the owner to revise the Draft Approved Plan of Subdivision ( 18T 88067 ) . By changing the location of the cul-de-sac, the lot configuration was affected. The following tables reflect these changes. � ( ; . . .4 REPORT NO.
