THAT Report PD-100-91 be received; 2 . THAT the preparation of Hamlet Secondary Plans for the Hamlets of Kendal, Leskard, and Mitchell Corners be held in abeyance; 3. THAT the interested parties listed in this report and any delegation be advised of Council 's decision. 1. BACKGROUND 1. 1 The Durham Regional official Plan is the governing planning policy document in the Regional Municipality of Durham. Policies for hamlet development are outlined by Section 10 . 4 of the Durham Regional official Plan. Section 10 .4 .2 . 1 of the Regional Plan states that "the delineation of the limits of and the detailing of land uses in Hamlets shall be undertaken in a development plan adopted by the Council of the respective area municipality prior to major new development taking place. " 1. 2 In September of 1989, the Planning and Development Department commenced with background research and data collection necessary for the preparation of a draft Hamlet Secondary Plan for the Hamlet of Leskard. The preparation of the draft secondary plan for Leskard has been hindered due to a difficulty in obtaining comments from the Ministry of the Environment and the Ministry of Transportation. The Ministry of the Environment has yet to n 2 REPORT NO. PD-100-91 PAGE 2 respond to a Hydrogeologic analysis prepared by Oceanfront Developments justifying development in Leskard. In addition the Ministry of Transportation has advised that they will provide comments pending the completion of the 407 Route Alignment Planning Study. 1. 3 In addition, background research and data collection commenced in anticipation of the preparation of Hamlet Secondary Plans for both Mitchell Corners and Kendal. The background research and data collection reached the stage where Staff was evaluating the planning rationale and merits of designating various parcels as "Residential Expansion" in the proposed draft Hamlet Secondary Plans . 2 . DURHAM REGION OFFICIAL PLAN REVIEW 2 . 1 The Regional Municipality of Durham has undertaken a review of the Regional Official Plan and the policies contained therein, including the policies which regulate the development of the Hamlets. Section 13. 3.5 of the recommended plan would require the completion of a Settlement Capacity Study to the satisfaction of the Region and the Ministry of the Environment prior to the development of the Hamlet Secondary Plan. The Settlement Capacity Study, which is to be undertaken by the local municipality, shall include the following: "a) an analysis of the hydrogeological regime in the area to determine the availability and quality of groundwater on a long term basis; b) an assessment of the impact of future development on existing groundwater quantity and quality and on existing sources of drinking water, including municipal, communal and private wells; c) an assessment of the long term suitability of the soil conditions for the effective operation of private waste disposal systems; d) an identification of any existing restrictions to future development; e) an assessment of surface drainage; f) an assessment of how new growth will be complimentary to, and consistent with, the historic character in the hamlet; g) an assessment of the impact of new growth on the natural environment; and rC} ( . . . . 3 REPORT NO. PD-100-91 PAGE 3 h) a statement of conformity with the Agricultural Code of Practice. " 2 .2 After reviewing the recommended plan, Staff have concluded that the requirement of Section 13 .3 .5 (f) through 13 . 3.5 (h) can be addressed "in house" by liaising with various agencies such as the Ministry of the Environment and the Central Lake Ontario Conservation Authority. However, the requirements of Section 13 . 3 .5 (a) through Section 13 . 3 .5(e) require specific skills and expertise, in particular, the preparation of a hydrogeological report and an environmental impact study. 2 . 3 Staff have contacted various consultants in order to obtain estimated costs for the preparation of a report detailing the work required by Section 13. 3 .5 of the recommended plan. The estimates provided ranged from $8500. per Hamlet to $13,000 per Hamlet. It is noted that these estimates are based upon a "typical Hamlet" and may be less or more than the estimate, depending upon the specific site conditions of the Hamlets. 2 .4 In reporting on the Durham Region Official Plan Review, Staff brought to Council's attention the cost of the settlement capacity requirements . Through Report PD-59-91, Council advised the Regional Municipality of Durham that the Town of Newcastle is of the opinion that Settlement Capacity Studies primarily deal with issues related to servicing and therefore, should be the responsibility of the Region. r 3 . STAFF COMMENTS 3 . 1 Although the completion of a Hamlet Plan for Leskard and the preparation of Hamlet Plans for Kendal and Mitchell Corners had been incorporated into the 1991 Work Program, there were no funds allocated to undertake the type of hydrogeological analysis required by the proposed Durham Region Official Plan policies. It would be pointless to proceed in view of the pending change in j Regional Plan policy. REPORT NO. PD-100-91 PAGE 4 3 .2 Staff advise, for the Committee's information, that once the recommended plan has been adopted by Regional Council and it is clearly established within the plan which level of government will be responsible for satisfying the requirements of Section 13 . 3.5, Staff will reactivate the preparation of the Hamlet Secondary Plans for Leskard, Kendal and Mitchell Corners provided sufficient funds will be allocated in the Department's budget in future years to carry out the settlement capacity study. 3 . 3 In view of the requirements of Section 13 . 3 . 5 of the recommended Regional Official Plan, and in consideration of the financial implications and other issues addressed in this report, Staff recommend that the preparation of the Hamlet Secondary Plans for the Hamlets of Kendal, Leskard and Mitchell Corners be held in abeyance.
