affl,ECT: AMENDMENT TO TOWN OF NEWCASTLE PARKING
BY-LAW #79-1
RECOMMENDATIONS:
It is respectfully recommended to Council the following:
1. THAT Report PD-329-89 be received;
2 . THAT Council approve the By-law attached to Report PD-329-
89 ;
3 . THAT Council designates the area as shown on Schedule A of
this Report as Free Parking Area for the week prior to
Christmas Day for 1989 and all subsequent years.
HISTORY:
1. For several years it has been the custom of the Town of
Newcastle to cover the parking meters in the downtown of
Bowmanville to allow free parking and encourage shopping at
certain times of the year.
2 . In 1978 Council enacted an amendment to Parking By-law 76-30
to allow Council to designate areas to be exempt from the
payment of parking. This exemption would be in the form of
a resolution and would specify the location and duration of
the exemption. (Attachment 1)

3 . On January 15, 1979, a new Comprehensive Parking By-law was
enacted (By-law 79-1) . The by-law repealed By-law 76-30 and
hence there is no authority for Staff to cover the parking
meters . (Attachment 2)
4 . In late November of this year the Bowmanville Business
Improvement Area again requested that the downtown corridor
of Bowmanville be exempted during the week before Christmas.

5. While researching the background information in preparation
for this, the above noted problem was discovered. In order to
rectify this situation, an amendment to the Parking By-law 79-
1 is necessary.
6 . The proposed by-law attached hereto will allow Council, by
resolution, to designate any municipal parking area for a
certain time period from payment of parking fees .

BY-LAW NO. 78-118
being a by-law to amend By-law #76-30
being a by-law to provide for the reg-
ulating of Parking, Standing and Stopping
on Highways under the jurisdiction of the
Corporation of the Town of Newcastle and
on private and municipal property.
The Council of the Corporation of the Town of Newcastle hereby
ENACTS AS FOLLOWS:
That Section IX of By-law No. 76-30 be amended by adding the following
subsection (10)
IX (10) Council, by resolution, may designate an area or areas for
a certain period to be exempt from the payment of parking fees.
BY-LAW READ A FIRST, SECOND AND THIRD TIME and finally passed this
18th day of December, 1978.

practicable to the parking meter for such space;
c) if a parking space has been designated by lines painted on the roadway,
no person shall park any vehicle in such a manner that it is not wholly
within the area designated as a parking space unless such vehicle is of such
length as to render it impossible to park it in one parking space in
which case the adjoining parking space shall, in addition, be used and the
necessary deposit of coins shall be made in the parking meters provided
for both parking spaces.
6) a) No person shall park a vehicle or permit a vehicle to remain parked in a
parking meter space if :
i) the parking meter has been covered by a parking meter cover;
ii) the parking meter has been removed from its standard,
b) Notwithstanding (a) above, only an authorized person shall park a vehicle
or permit a vehicle to remain parked in a parking meter space where the
meter has been covered or removed to indicate reserved parking) and stating
"'NO PARKING ".
7) For the purposes of determining violations of the use of the parking meter or
the parking space, the fact that the parking meter governing the parking space
indicates that the vehicle is unlawfully parked is prima facie evidence that
such vehicle is unlawfully parked.
8) No person shall deposit or cause to be deposited in any parking meter any slug,
device or other substitute for a coin of the Dominion of Canada.
9) No person shall deface, conceal, injure, tamper with, open or wilfully break,
destroy or impair the usefulness of any parking meter erected under the
authority of this By-law.
10) Nothing in subsections (2) , (3) , (4) and (S) of this section shall be deemed
to permit a driver to stop or park at any location where, or at any time when
stopping or parking is otherwise prohibited.

Dear Mrs . Barrie
It was my understanding , based on a letter which I
sent to Council some years ago , that a formal letter
to request that there be free parking in the Down-
town during Christmas Week was no longer necessary.
However, because these arrangements do not exist in
by-law form, it is deemed necessary that a letter be
sent to Council to ensure that free parking in the
Downtown is approved for 1989. As a result , please
accept this letter as our official request for this
to be done.
If possible, we would be pleased if the bags could
be placed on the meters late Friday afternoon on
December 15 and not be removed until Wednesday,
December 27, to allow for a full week and Boxing
Day.
Our thanks to you and the staff of the Town for your
co-operation and support over the year, and our beast
wishes for a happy holiday season and a good New Year!
