RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. THAT Report PD- 312 -89 be received;
2 . THAT application by N. Palladino to amend the Town of
Newcastle Comprehensive Zoning By-Law be referred back to
Staff for further processing and the preparation of a
subsequent report upon receipt of all outstanding comments;
and
3. THAT the interested parties listed in this report and any
delegation be advised of Council's decision.

2 . LOCATION
2 . 1 Legal Description: Part Lot 30, Concession 3, former
Township of Darlington, (Courtice Major
Urban Area)
2 .2 Relative Location: 291 m (956 ft) north of Nash Road on the
East side of Trulls Road
3 . BACKGROUND
3 . 1 The application to amend the Comprehensive zoning By-Law was
made on July 7, 1989 by Mr. Nick Palladino on behalf of Mr.
J. Masters . This original application was to permit the
development of a lot for a single detached dwelling. The
subject lands were subsequently purchased by Mr. Palladino
and the application revised on October 23, 1989 to permit
the development of a semi-detached/link dwelling.
4 . EXISTING AND SURROUNDING USES:
4 . 1 Existing Uses: single family residential
4.2 Surrounding Uses: East- vacant; land under site plan
application for Townhouse &
Apartment complex
West- residential subdivision
North- currently vacant; also the
subject of Subdivision

5 . OFFICIAL PLAN POLICIES
5 . 1 Durham Region Official Plan
The subject site appears to be designated "Residential" in the
Durham Region Official Plan. The predominant use of lands so

designated shall be for residential purposes. Residential
development shall generally proceed by registered plan of
subdivision. It should be noted that the Durham Plan requires
all development to be full serviced with sanitary sewer and
water supply services unless prior arrangement is made with
the Region for future service connection.
5 .2 Town of Newcastle Official Plan
Similarly, within the Town of Newcastle Official Plan
(Courtice Major Urban Area) , the subject lands are designated
"Residential" . The proposal appears to comply with the
Official Plan provisions.
6 . ZONING
6 . 1 The subject lands are currently zoned "Agricultural (A) " by
By-law 84-63, in the Town of Newcastle Comprehensive Zoning
By-law.
6 .2 The proposed rezoning application would change the zoning to
an appropriate "Residential" category to permit the proposed
development.
7 . PUBLIC NOTICE
7 . 1 Pursuant to the requirements of the Planning Act and Council
policy, notice of the Public Meeting with respect to the
subject rezoning amendment submitted by Mr. Nick Palladino
was mailed to all property owners with 120m ( 394 ft. ) of the
subject site. In addition, the appropriate signage

acknowledging the application was installed on the subject
lands .
7 .2 As of writing this report, no written submissions have been
received.
8. COMMENTS FROM AGENCIES
8 . 1 In accordance with departmental procedures, the application
was circulated to obtain comments from other departments and
agencies. The following departments/agencies in providing
comments, offered no objection to the application as filed:
- Town of Newcastle Fire Department
- Durham Regional Health Department
- Ministry of Agriculture and Food
- Region of Durham Planning Department
8 .2 Staff notes that the Town of Newcastle Community Services
Department requested that the 5% park land dedication be
accepted as cash-in-lieu.
8 .3 The Town of Newcastle Public Works Department requested that
the Applicant will bear the cost ( 100%) of any works on
Trulls Road which are necessitated as a result of this
development and that monetary contributions are made to the
reconstructing/upgrading of Trulls Road ( 15m x $476 .50/m =
$7, 147 .50) . In addition, it was noted that a satisfactory lot
grading plan is to be submitted and a 5 . 18m road widening is
to be dedicated to the Town along with a 0. 3m reserve. The
Public Works Department also asked that any easements required
by the Town be granted free and clear of any encumbrances and
that an application for property access be made. Staff would

note that the above conditions would be addressed through the
owner's submission of a Land Division application.
8 .4 Durham Region Public Works Department noted that Regional
sanitary sewer services are not presently available to service
the subject property and that the applicant will be
responsible for the entire cost of extending sanitary sewer
services . The estimated cost for the extension is $46,000 . 00,
at 1989 rates. The Region has advised that their requirements
would be addressed similarly through the Land Division
Committee application process .
9 . CONCLUSION
9 . 1 As the purpose of this report is to address the requirements
of a Public Meeting under the Planning Act, Staff recommends
the application be referred back to Staff for further
processing.
