SUBJECT: EXTENSION OF LETTER OF UNDERTAKING RE: USE OF TEMPORARY
LIVING QUARTERS - JAMES D. BROOKS
RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1 . THAT Report PD- 304-89 be received;
2 . THAT the request for an extension of the letter of
undertaking, be approved and Mr. James Brooks be so advised.
1. BACKGROUND:
1. 1 Under the provisions of Zoning By-law 84-63 Section 3 .22 (b)
"Special Uses Permitted" which permits

"the use of temporary living quarters on a lot
for residential purposes may be permtted on a
temporary basis, for a period not to exceed
six (6) months, while a permitted dwelling is
under construction, provided that said
temporary living quarters shall be removed
from the said lot immediately after the
expiration of this six (6) month period or
with the occupation of the new dwelling,
whichever occurs first. Notwithstanding the
time limitation of this provision, subject to
the approval of Council, temporary living
quarters may be used for a period exceeding
the six (6) months permitted herein. "
James D. Brooks signed a letter of undertaking on May 1, 1989
to inhabit an existing dwelling for a maximum of 6 months
while a new dwelling was under construction on the same lot.
1.2 The letter of undertaking expires on November 20, 1989 and
James D. Brooks has submitted a written request (copy attached
to this report) for an extension to May 1, 1990 . The person
who was to remove the existing dwelling is unable to do so
because of personal matters .
2 . COMMENT:
2 . 1 At this time the dwelling under construction is at the
insulation stage and should be complete by mid November.
3 . RECOMMENDATION:
3 . 1 As it is the intention to store the existing building on the
same lot, Staff recommend the granting of one extension as
requested provided (a) all services such as hydro, heat and
water be disconnected, (b) notification of discontinuation of
services form be obtained and (c) the building not be used for
any purpose while stored on the lot.

Existing Dwelling
This house has been sold to Rodger Cochrane of Bowmanville"'
for possession on November 11 , 1989.
Whereas Mr. Cochrane had intended to remove the dwelling
by November 16, 199Q but due to personal family matters,
has asked for an !,'extention 00undation move, T am requesting
an extention date to May 1 , , He has the intention
of removing the house from by November 16
but may have to store it in our field until the purchase
of a suitable lot.
Your attention to this matter would be appreciated.

LETTER OF UNDERTAKING
I/We JAMES D. BROOKS owners of
the following lands;
Part Lot 29, Concession 9, former Township of Darlington, now Town
of Newcastle
intend to cons ruct a new residence on the said lands for completion
by //'� 2�0 19�/•
It is understood that I/We may inhabit the existing dwelling during
the construction period of the proposed new residence.
It is further understood and agreed that I/We will:
1. Conform with all Municipal By-laws in the construction of
the single family home.
2. Inhabit the existing dwelling on a temporary basis while the
new single family home is under construction for a period of
six months from the date construction begins.
3. Upon expiration of the six month period or the occupation of
the new residence, whichever occurs first, remove the
existing dwelling immediately.
4. At no time allow the new residence and the existing dwelling
to be occupied simultaneously.
5. One month before the expiry date request Council's approval
to exceed the six month period should it be necessary to
complete the construction of the new residence.
