SUB.ECT: PROPOSED MODIFICATIONS TO SECTION 9 OF THE TOWN OF NEWCASTLE
OFFICIAL PLAN (HAMLETS)
RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1 . THAT Report PD-347-90 be received;
2 . THAT Report PD-347-90 be forwarded to the Ministry of Municipal
Affairs and the Region of Durham Planning Department as the Town
of Newcastle's response to Modification 4(b) as proposed by the
Ministry of Municipal Affairs in respect of Section 9 of the Town
of Newcastle Official Plan; and
3 . THAT the Region of Durham Planning Department, the Ministry of
Municipal Affairs and the interested parties indicated in this
Report be advised of Council 's decision.
1. BACKGROUND
1. 1 Council, at its meeting of November 12, 1990, considered Report PD-
333-90 which addressed the modifications to Section 9 (Hamlets) of
the Town of Newcastle Official Plan as proposed by the Ministry of
Municipal Affairs .
1.2 Mr. R. Martindale of the Greer Galloway Group addressed Council in
respect of Report PD-333-90, specifically the response to Ministry
Modification 4(b) as proposed by Staff. Council resolved to adopt

modifications, but further resolved to refer the Town' comments on

Ministry Modification 4(b) back to Staff.
1.3 Ministry Modification 4(b) states that the existing policies in
Section 9 of the Town's Official Plan should be modified to clarify
the basis by which a hamlet can be designated as a "Hamlet for
Growth" and for determining the growth limit.
1.4 In response, Staff recommended in Report PD-333-90 that Section
9 .4 iii) a) be amended to read as follows:
119 .4 iii) a) all lands designated short term residential
expansion are occupied by registered plans of
subdivision, and building permits have been issued
for 75 percent of the lots in these subdivisions. "
The intent of the modification as recommended by Staff was to
clarify the current wording which requires that 'Residential
Expansion Areas ' be "substantially developed" .
2 . COMMENTS
2 . 1 As the result of discussions with Mr. Martindale regarding his
concerns with the wording of Section 9 .4 iii) a) , Staff recommend
that this section be amended to read as follows (proposed changes
underlined) :
119 .4 iii) a) Plans of Subdivision, or lots created through
consent, have been registered for all lands
designated Short Term Residential Expansion, and
provided that building permits have been issued for
75 percent of the lots, or one year has elapsed
since the date of the last plan registered,
whichever comes first. "
