RECOMMENDATIONS:
It is respectfully recommended to Council the following:
1. THAT Report PD-302-90 be received for information.
1. PURPOSE
1. 1 The purpose of this report is to advise Council of the
status of the Official Plan Amendment and Rezoning
applications related to Laidlaw's Infill Proposal, and the
Official Plan Amendment application related to Laidlaw's
leachate forcemain proposal.
2. INFILL PROPOSAL
2 . 1 The final technical documents submitted in support of the
Laidlaw Infill Proposal were circulated to various agencies
for comment by the Town and the Region of Durham in January
1990 . To date, comments remain outstanding from the
Ministry of the Environment. Ministry Staff have verbally
advised Town Staff that their review of the technical
documents submitted by Laidlaw is incomplete.

2 .2 Acres International, the consulting firm retained by the
Town to assist in the review of the technical documents for
the Infill Proposal, has submitted their preliminary
comments. Acres has identified concerns with the
'Hydrogeology' Report, in particular the method used to
determine the hydraulic conductivity of soils, the
effectiveness of the Rapid Infiltration Basins in reducing
leachate concentrations, and the use of the Ministry of the
Environment's 'Reasonable Use' Policy for determining off-
site impacts arising from groundwater contamination.
The Planning Department has advised the applicant of these
concerns and has requested the submission of additional
technical information to address these deficiencies.
2 . 3 Laidlaw has requested that all applications concerning the
Infill Proposal be scheduled for a Consolidated Hearing.
The Consolidated Hearings Board has advised that referral
of the Official Plan Amendment application must proceed
prior to the scheduling of a hearing.
2 .4 The Ministry of Municipal Affairs has requested the Town to
submit its comments on the Infill Proposal as soon as
possible. Town Staff have advised the Ministry that the
comments of the Ministry of the Environment are of critical
importance to the Town's review of the Official Plan
Amendment and Rezoning applications, and that the Town's
comments will be forthcoming at such time as the comments of
the Ministry of the Environment have been received and
reviewed by the Town.
3. LEACHATE FORCEMAIN PROPOSAL
3. 1 Official Plan Amendment Application 89-39/D submitted by
Laidlaw seeks to permit a sanitary sewage forcemain and

related capacity in the Graham Creek Water Pollution
Control Plant for leachate created at the landfill site. By
letter dated March 1, 1990 to the Consolidated Hearing
Board, Laidlaw advised that, at the present time, it does
not intend to proceed before the Board with the leachate
forcemain proposal.
However, Laidlaw has advised the Region that it does not
wish to withdraw the related Official Plan Amendment
application and has requested that the application be dealt
with in due course. As a result, this application is
currently being held in abeyance by Town Staff.
