OF DARLINGTON FILE: DEV 90-047 (X-REF: OPA 90-045/N) RECOMMENDATIONS: It is respectfully recommended that the General Purpose & Administration Committee recommend to Council the following: 1. THAT Report PD- 204-90 be received; 2 . THAT the application to amend the Town of Newcastle Comprehensive Zoning By-law 84-63, as amended, submitted by the Greer Galloway Group Inc . on behalf of Carnovale Construction Limited, be referred back to Staff for further processing and the preparation of a subsequent report pending the receipt of all outstanding comments; and 3. THAT a copy of Committee's and Council's decision be forwarded to the interested parties attached hereto. 1. APPLICATION DETAILS 1. 1 Applicant: Carnovale Construction Ltd. 1.2 Official Plan Amendment: To introduce a High Density (H) symbol on the subject property to permit the development of a 48 unit apartment building. . . . /2 REPORT PD- 20490 PAGE 2 1. 3 Rezoning: From "Agricultural (A) " to an appropriate zone to implement the above noted development. 1.4 Area: . 65 hectares ( 1. 6 acres) 2. BACKGROUND 2 . 1 In May of 1990, the Town of Newcastle Planning and Development Department received an application to amend the Town of Newcastle Comprehensive Zoning By-law 84-63 in order to permit the development of a 48 unit apartment building. 2 .2 On May 9, 1990, the Region of Durham advised the Town of Newcastle that the applicant had also applied to amend the Town of Newcastle Official Plan in order to permit the aforementioned development. 2 . 3 The subject property is a rectangular shaped parcel approximately . 65 hectares ( 1.6 acres) in size and is located at the south-west corner of Highway #2 and Green Road but is more formally described as Part Lot 17, Concession 1, in the former Township of Darlington. 3. PUBLIC NOTICE 3. 1 Pursuant to Council's resolution of July 26, 1982, and the requirements of the Planning Act, the appropriate signage acknowledging the application was installed on the subject lands . In addition, the appropriate notice was mailed to each landowner within the prescribed distance. 3 .2 As of the writing of this report, the Planning and Development Department has not received any written submissions with respect to the subject application. However, the Planning and Development Department has received one counter inquiry with respect to the subject application during which concerns over the density of the proposal were expressed. 4. OFFICIAL PLAN CONFORMITY 4 . 1 Within the Durham Regional Official Plan, the subject property is designated as a Residential Area. As residential uses are intended to be the predominant use of property so designated, it would appear that the proposed conforms with the intent of the Durham Regional Official Plan. . . . /3 REPORT PD- gu-90 PAGE 3 4 .2 Within the Town of Newcastle Official Plan (Bowmanville Major Urban Area) , the subject property is designated "Low Density Residential" . Residential dwellings are intended to be the predominant use of lands so designated. 4 . 3 The Town of Newcastle Official Plan establishes within the Bowmanville Major Urban Area a maximum of 30 units per net residential hectare for Low Density Residential development, 30 - 55 units per net residential hectare for Medium Density Residential development and a maximum of 80 units per net residential hectare for High Density Residential development. The subject property is designated in the Official Plan to develop at a maximum of 30 units per net residential hectare. The applicant, however, is proposing to develop the subject property at 73 . 85 units per net residential hectare, which would require the introduction of a High Density (H) symbol on the subject property within the Town of Newcastle Official Plan in order to implement the proposed development. 5. ZONING BY-LAW CONFORMITY 5 . 1 Within the Town of Newcastle Comprehensive Zoning By-law 84- 63, the subject property is zoned "Agricultural (A) " . As residential uses of the size and magnitude proposed in the current application are not permitted within the current zone category, the applicant has applied to appropriately amend the zoning by-law. 6. AGENCY COMMENTS 6 . 1 The Town of Newcastle undertook a joint circulation of the Official Plan Amendment application and the Zoning By-law Amendment application. The following provides a summary of comments received to date relating to the proposal. 6 .2 The Ministry of Natural Resources has reviewed the proposal and notes that the subject property is located in the Westside Creek Watershed which provides a sensitive warmwater habitat and spawning area for Lake Ontario fish species . However, the Ministry of Natural Resources has no objection to the proposal but wishes to review any stormwater management plans which are prepared for the site. . . . /4 529 REPORT PD-204 -90 PAGE 4 6 . 3 The only other agency/department which has provided comments is the Town of Newcastle Fire Department which had no objection to the proposal. The Town of Newcastle Public Works Department, the Community Services Department, the Central Lake Ontario Conservation Authority, the Ministry of Transportation, the Regional Planning Department and the Regional Works Department have all yet to respond to the circulation. 7. STAFF COMMENTS 7 . 1 As the purpose of this report is to address the requirements of a Public Meeting under the Planning Act and in consideration of comments outstanding, the Planning and Development Department recommends that the application be referred back to Staff for further processing.
