REZONING APPLICATION - MELROSE LONG TERM CARE MANAGEMENT
SECT: PART LOT 9, CONCESSION 1, BOWMANVILLE

RECOMMENDATIONS:
it is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. THAT Report PD-222-90 be received;
2 . THAT rezoning application DEV 90-037 submitted by Liaquat Siddiqui
on behalf of Melrose Long Term Care Management Company Limited to
permit a three storey addition to the existing building be
APPROVED.
3 . THAT the amending by-law be passed at such time as the applicant
has entered into a site plan agreement with the Town.
4 . THAT the Region of Durham Planning Department and the interested
parties listed in this report and any delegation be advised of
Council's decision.
1 . APPLICATION DETAILS:

"Urban Residential Exception (Rl-3) " .

2 . LOCATION:
2 . 1 The subject property is located in Part Lot 9, Concession 1,
Bowmanville, further defined as 262 King Street East. A single
family residence occupies the site. The abutting property, 264
King Street East is the site of the Strath Manor/Strathaven Nursing
Home.
3. BACKGROUND
3. 1 On March 23, 1990, the Planning Department received an application
to amend the Town of Newcastle Comprehensive Zoning By-law 84-63,
as amended. The Owner wishes to build a three (3) storey addition
to the Strath Manor/Strathaven Nursing Home. This addition will
accommodate an additional 74 beds . The present facility has 208
beds .
3 .2 In accordance with the provisions of the Planning Act a Public
Meeting was held on May 7, 1990 . Records from this meeting reveal
that no one spoke in opposition to this application.
4 . EXISTING AND SURROUNDING USES:
4 . 1 Existing Uses: The existing Strath Manor/Strathaven Nursing Home
and a Single family residence
4 .2 Surrounding Uses:
East: Single family residence
West: Plan of Subdivision 18T-88071, Draft approved
and a proposed 500 m 2 commercial plaza.
South: Bowmanville Mall
North: Plan of Subdivision 18T-88071, Draft Approved.
5 . OFFICIAL PLAN POLICIES
5 . 1 In the Town of Newcastle Official Plan the property is designated
"Community Facilities" and "Medium and High Density Residential" .
Section 7 .4 . 1.4 of this plan states. . . .

"The internal boundaries and alignments of the components of the
Bowmanville Major Urban Area are approximate only and are not
intended to mark the exact location or extent of the designation
of such components except where such designation coincides with
arterial or collector roads, railways, valleys, transmission lines,
or other clearly recognizable physical features. The exact
internal boundaries shall be defined at such time as the restricted
area (zoning) by-laws come into effect. "
It has been determined that this application complies to the intent
of the Official Plan.
6 . ZONING:
6 . 1 The property on which the proposed addition is to be built is zoned
"Holding - Urban Residential Type Three ( (H) R3) " . Land so zoned
shall be used for residential purposes . The Strath Manor/
Strathaven Nursing Home is zoned "Urban Residential Exception (Rl-
3) " which permits a nursing home.
Therefore, in order to permit the extension to the existing
facility, rezoning the remainder of the property to R1-3 is
required.
7 . PUBLIC NOTICE AND SUBMISSIONS
7 . 1 Pursuant to Council's resolution of July 26, 1982 and the
requirements of the Planning Act, the appropriate signage
acknowledging the application was installed on the subject lands.
In addition the appropriate notice was mailed to each landowner
within the prescribed distance.
As of the writing of this report, no written submissions have been
received.
8 . AGENCY COMMENTS
8. 1 In accordance with departmental procedures, this application was
circulated to obtain comments from other departments and agencies.
The following department/agencies in providing comments, offered
no objection to the application as filed:

- Ministry of Natural Resources
- Ministry of Transportation Ontario

8.2 The Town of Newcastle Public Works Department and Community
Services Department have responded positively but have requested
that certain requirements be met by the applicant/owner. Public
Works have asked that site grading plans be submitted, that a
performance guarantee for external works be provided,
that the applicant/owner make application for property access, that
the applicant bear the costs of any works on King Street which are
necessitated as a result of this development and that the Public
Works Department is satisfied, financially and otherwise.
Community Services has requested that the King Street frontage be
appropriately landscaped and that consideration be given to
providing outdoor seating and patio areas .
In addition, the Newcastle Fire Department noted that the plans
must be reviewed by the Office of the Fire Marshall prior to final
approval .
Also it was stated in comments submitted by the Regional Works
Department that if additional services are required, six (6) copies
of site servicing drawings must be submitted for site plan
approval .
9 . STAFF COMMENTS
9 . 1 Amenities such as shopping, parks and medical facilities are
important to the elderly. The Strath Manor/Strathaven Nursing Home
is currently located within walking distance to these facilities .

9 .2 Staff note that the Strath Manor/Strathaven Nursing Home is covered
by an existing Site Plan Agreement (DEV 82-38) . This agreement
must be amended. The amending by-law will be forwarded to Council
for enactment when the owner has entered into an amending site plan
agreement.
10. CONCLUSIONS:
10. 1 Considering the above noted comments, Staff respectfully
recommended that the rezoning application be APPROVED.
