SAC : REQUEST FOR SPECIAL EXEMPTION UNDER NOISE BY-LAW 89-184
RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. THAT Report PD-233-90 be received; and
REPORT:
1. 1 Staff have received a request from Foran's Roofing and Sheet Metal
Limited, 111 Warren Road, Box 4, Whitby, Ontario L1N 5R7 to allow
for special exemption under the By-law.
1 .2 The company in question is under contract to replace the existing
roof at Vincent Massey School, Church Street, Bowmanville, Ontario
and are requesting to be permitted to commence work at 5:00 a.m.
instead of 7 : 00 a.m. as prescribed under Section 2, Subsection (J)
of the By-law. The reason for the request is to allow for the easy
removal of the material on the roof which, once heated by the sun
becomes difficult to remove.
1 . 3 Staff understand the reasons brought forward by the applicant
however, should exemption be granted it would set a precedent
and open the door for further exemptions to be made, thus
weakening the integrity of the By-law.

1. 4 Staff cannot therefore support this request for exemption under
Noise By-law 89-184 .
