PART LOT 19, CONCESSION 1, FORMER TOWNSHIP OF CLARKE FILE: OPA 90-042/D, DEV 90-019, 18T-90023 RECOMMENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PD-234-90 be received; 2 . THAT the, applications submitted by 168125 Canada Inc. to amend the Durham REgion Official Plan, to amend the Town of Newcastle Comprehensive Zoning By-law 84-63, and for approval of Plan of Subdivision, be referred back to staff for further processing and the preparation of a subsequent report upon receipt of all outstanding comments; and 3 . THAT the interested parties listed in this report and any delegations be advised of Council's decision. 1. APPLICATION DETAILS 1. 1 Applicant: 168125 Canada Inc. 1.2 O.P.A. : From "General Agricultural Area" to "Estate Residential" 1. 3 Subdivision: Thirty (30) Single Family Estate Residential Lots REPORT NO. : PD-234-90 PAGE 2 1.4 Rezoning: From "Agricultural (A) " to an appropriate zoning to permit development 1.5 Area: 24 .295 ha (60.032 acres) 2. BACKGROUND 2 . 1 On February 8, 1990 the Town of Newcastle Planning and Development Department received a rezoning application, submitted by 168125 Canada Inc . The applicant proposes the development of a thirty (30) lot estate residential subdivision. 2 . 2 Subsequently, on May 11, 1990 and May 24, 1990, the Town of Newcastle Planning and Development Department received notice from the Region of Durham of an Official Plan Amendment and Subdivision Application respectively. 3. LOCATION 3. 1 The subject site is located in Part Lot 19, Concession 1, in the former Township of Clarke. The subject site is located south of Highway No. 2 on the west side of Brownsville Road. 4. EXISTING AND SURROUNDING USES 4. 1 Existing Uses: Vacant 4 . 2 Surrounding Uses: East - Residential West - Agricultural/Residential South - Commercial (Gas Station & Burger King) North - Residential REPORT NO. : PD-234-90 PAGE 3 5. PUBLIC SUBMISSIONS 5 . 1 No public submissions have been received to date. 6. OFFICIAL PLAN POLICIES 6 . 1 The subject site is presently designated "General Agricultural" . A limited number of estate-residential subdivisions on large lots may be permitted as an exception to the "General Agricultural" and "Major Open Space" policies by amendment to the Durham Region Official Plan. The limits to the numbers of such estate-residential subdivisions shall be established by their scale and location, their financial implications for the Region and their effect on the Region's transportation facilities and utilities . 7. AGENCY COMMENTS 7 . 1 In accordance with Departmental procedure, the subject application was circulated to various agencies and departments for their review and comment. The following agencies/departments offered no objection to this application: Durham Region Works Department Ministry of Agriculture and Food Ontario Hydro The following agencies have offered no objection to the principle of this application, but have outlined conditions for draft approval: Town of Newcastle Public Works Department Town of Newcastle Community Services Department Ganaraska Region Conservation Authority Public School Board Ministry of Natural Resources Bell Canada 5 GJ3 REPORT NO. : PD-234-90 PAGE 4 7 .2 The town of Newcastle Fire Department have provided the following comments: This site falls within the recognized response area of Station #2, Newcastle Village. Approximate response time will be in the area of 6 to 8 minutes . Since this site is not serviced by municipal water, it must be treated as a rural response and therefore water for firefighting purposes must be supplied by Fire Department tanker trucks. It should be noted that Regional water runs on the north side of Highway #2 in this area and access to this should be considered. If there is not a fire hydrant in the immediate area, then consideration should be given to the applicant providing a reservoir in the area of the subdivision to supply water for firefighting purposes. 7 .3 Comments are still outstanding from the Ministry of the Environment and the Ministry of Transportation. 8. TECHNICAL STUDIES SUBMITTED BY THE APPLICANT 8 . 1 An application to amend the Durham Region Official Plan for estate residential development, is to be accompanied by the following technical studies: A preliminary analysis of the soil and ground-water conditions of the site indicating satisfactory conditions for private servicing; A preliminary analysis of the landscape features of the site and adjacent properties which indicates the suitability of the site for estate-residential uses; REPORT NO. : PD-234-90 PAGE 5 A preliminary statement of all possible modification to the natural features of the site required for the development of the site. 8 .2 The applicant has submitted, an "Environmental Considerations Analysis" , prepared by G.M. Sernas and Associates, and a "Hydrogeological and Geotechnical Assessment" prepared by Gibson and Associates . 8.3 The Environmental Consideration Analysis indicated the possibility of lower levels of long term chronic sedimentation resulting from stormwater discharge as well as potential noise impacts from Highway No.2 and Highway No.401. The Hydrogeological and Geotechnical Assessment indicated comparatively shallow water table surface in the general area. Notwithstanding these findings, the consultants have noted corresponding mitigative measures as part of their recommendations with respect to this proposal, as such support the estate residential proposal. These technical reports will be further revised by staff in consultation with the Ministry of the Environment and other agencies . 9. STAFF COMMENTS 9 . 1 The purpose of this report is to facilitate the Public Meeting as required by the Planning Act, and to provide Committee and Council with some background on the applications submitted.
