CT. MONITORING OF THE DECISIONS OF THE COMMITTEE OF ADJUSTMENT
RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. THAT Report PD-278-90 be received;
2 . THAT Council concur with the decisions of the Committee of
Adjustment on Applications A90/43 to A90/55 inclusive, save and
except A90/47; and
3 . THAT Staff be authorized to appear before the Ontario Municipal
Board to defend the decisions of the Committee of Adjustment in the
event of an appeal.
1. BACKGROUND:
1. 1 The Committee of Adjustment heard applications on July 5, August
2 and August 30, 1990 . The Committee dealt with a total of
thirteen ( 13) applications during the three (3) meetings.
Application A90/48 was DENIED as the. Committee did not considered
it to be minor in nature; Two (2) applications (A9.0/51 and A90/52)
were TABLED to the next available meeting date at which time A90/52
was APPROVED and A51/90 was TABLED again at the request of the
applicant. The balance of the applications were all APPROVED as
applied for save and except application A90/47 .

1.2 Application A90/47 was APPROVED by the Committee subject to
conditions. The applicants for A90/47 did not believe the
Committee dealt with the application as filed and have APPEALED the
decision of the Committee to the Ontario Municipal Board. The
application proposed to construct a second dwelling on a lot having
15 . 8 Ha instead of the required 20 . 0 Ha. The Committee approved
the application subject to the existing seasonal dwelling use
ceasing to continue upon completion of the new dwelling (becomes
inhabited) .
Staff would concur with the applicant's comments and cannot support
the Committee's decision and as a result will not appear before the
Ontario Municipal Board to defend the Committee's decision.
1.3 Staff have reviewed the balance of the Committee's decisions and
are satisfied that the decisions conform to the general intent of
the Official Plan and the Zoning By-law and that the variances
sought are minor in nature.

1.4 Council 's concurrence with the Committee of Adjustment decisions
is required in order to afford Staff's official status before the
Ontario Municipal Board in the event of appeal of the decisions of
the Committee of Adjustment.
