ACT: PART LOTS 17 AND 18, CONCESSION 7, FORMER TOWNSHIP OF CLARKE FILE: DEV 90-063 RECOMMENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PD-250-90 be received for information; 2 . THAT a copy of this report be forwarded to the Region of Durham. 3 . THAT any delegation and those persons listed in this report be advised. 1. APPLICATION DETAILS 1. 1 Applicant: Mican Investments Ltd. 1.2 Rezoning: From 'Agricultural (A) I and 'Environmental Protection (EP) ' to an appropriate zoning to permit development. 1. 3 Proposed Development: A thirty (30) lot estate residential subdivision. 1.4 Area: 52,829 ha ( 130 .539 acres) ,) 99 61 REPORT NO. : PD-250- 90 PAGE 2 1.5 Location: The subject site is located in Part Lots 17 and 18, Concession 7 , in the former Township of Clarke. The relative location of subject site is east of Oak School Road, south of Concession Road 8, and north of the Oshawa Ski Club. The subject site is located within the Ganaraska Headwater. 2. BACKGROUND 2 . 1 On June 6, 1990, the Town of Newcastle Planning and Development Department received a rezoning application submitted by Conrad M. Marini on behalf of Mican Investments Ltd. The applicant wishes to rezone the subject site to permit the development of a thirty lot estate residential subdivision. 2 .2 The applicant has submitted corresponding Official Plan Amendment and Subdivision Applications to the Region of Durham, however, the Region has informed both the applicant and the Town that they will not be circulating this application until such time as the applicant provides further information to the Region. 2 . 3 On February 13, 1989, the Council of the Town of Newcastle resolved that the Town of Newcastle request the Region of Durham to implement a major study of the Ganaraska area within the Region of Durham before any further development applications for Official Plan Amendments are processed so as to accurately assess the environmental impacts of any such development. 599 62 REPORT NO. : PD-250-90 PAGE 3 2 .4 On February 27, 1989, the Town of Newcastle responded to the Ontario Environmental Assessment Advisory Committee, Report No. 38 to the Minister, "The Adequacy of the Existing Environmental Planning and Approval Process for the Ganaraska Watershed" . The EAAC recommended that a temporary moratorium be placed on Official Plan Amendments until such time as environmental studies have been carried out by the Region of Durham. The Town agreed with this recommendation for a moratorium, but added that the moratorium should be placed on future Official Plan Amendments, and not on those applications which were presently being processed. 2 .5 The environmental studies recommended by both the Town and the EAAC, have not been conducted to date by the Region of Durham. 3. CONCLUSION 3 . 1 It is Council's position not .to process any further Official Plan Amendment applications within the Ganaraska headwaters until environmental studies have been carried out by the Region of Durham. Since the development proposed by Mican Investments will require an Official Plan Amendment in addition to the rezoning application already submitted, Staff will accordingly receive the rezoning application but will not process the application further at this time.
