GRAY PART LOT 28, CONCESSION 2, TOWNSHIP OF CLARKE FILE: DEV 90-073 RECOMMENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PD-291-90 be received; 2 . THAT application to amend the Town of Newcastle Comprehensive Zoning By-law 84-63, as amended, submitted by G. Gray on behalf of Sonbon Homes Ltd. be referred back to Staff for further processing and the preparation of a subsequent report upon receipt of all outstanding comments; and 3 . THAT the interested parties listed in this report and any delegation be advised of Council's decision. 1. APPLICATION DETAILS 1. 1 Applicant: G. Gray 1.2 Owner: Sonbon Homes Ltd. 1. 3 Rezoning: From "Urban Residential Type One Exception (Rl-1) " to "Urban Residential Type One (R1) " to permit a ( 179 .5 m2) addition to the existing structure creating a semi-detached dwelling. 1.4 Area: 725 m2 a �. REPORT NO. : PD-291-90 PAGE 2 2 . LOCATION 2 . 1 The subject property is located in the north west corner of Wilmot Street and Manvers Street in the Village of Newcastle. The municipal address is 20 Manvers Street. The property can be further defined as located in Part Lot 28, Concession 2 former Township of Clarke. 3. BACKGROUND 3 . 1 On August 2 , 1990 the Town of Newcastle Planning Department received an application to amend the Town of Newcastle Comprehensive Zoning By-law 84-63, as amended. The applicant seeks to obtain a rezoning in order to permit a semi-detached dwelling to be established on the property. 3 .2 The applicant wishes to build an addition to the existing single family dwelling. This addition will be used as a second dwelling, hence creating a semi-detached dwelling. However, semi-detached dwellings are not a permitted use on the property as presently zoned. 3. 3 It is noted that the applicant wishes to demolish the framed garage which is currently on site. 4 . EXISTING AND SURROUNDING USES 4 . 1 Existing Uses: single family dwelling and frame garage Surrounding Uses: East - Existing Residential West - Existing Residential South - Existing Residential North - Existing Residential 5. OFFICIAL PLAN 5 . 1 According to both the Durham Region Official Plan and the Town of Newcastle Official Plan, the subject property is designated Residential. Since this application is to permit a semi-detached residential dwelling, conformity to the respective Official Plans exists . (� , , , , 3 REPORT NO. : PD-291-90 PAGE 3 6 . ZONING BY-LAW 6 . 1 On Schedule 115" of the Town of Newcastle Zoning By-law, the site in question is zoned "Urban Residential Type One Exception (R1- 1) " . The zoning permits single family dwellings . However, semi- detached dwellings are not permitted in the "Rl-1" zone, hence requiring an amendment to the zoning by-law. 6 .2 According to Section 12 .2 of the By-law, the existing single family dwelling is deficient in both interior and exterior side yard requirements (Table 1) . PUBLIC MEETING 7 . 1 Pursuant to Council's resolution of July 26, 1982 and the requirements of the Planning Act, the appropriate signage acknowledging the application was installed on the subject lands. In addition the appropriate notice was mailed to each landowner within the prescribed distance. 7 .2 As of the writing of this report, no written submissions have been received. 8. AGENCY COMMENTS 8 . 1 In accordance with departmental procedures, the application was circulated to obtain comments from other departments and agencies. The following department/agencies in providing comments, offered no objection to the application as filed: . . .4 REPORT NO. : PD-291-90 PAGE 4 Town of Newcastle Fire Department - Newcastle Hydro Electric Commission - Durham Region Health Unit - Ganaraska Region Conservation Authority Comments have yet to be received from: - Town of Newcastle Public Works - Town of Newcastle Community Services - Durham Region Planning Department - Northumberland Newcastle Board of Education - Peterborough-Victoria-Northumberland-Newcastle Roman Catholic Separate School Board 9 CONCLUSION 9 . 1 As the purpose of this report is to address the requirements of a public meeting under the Planning Act, and in consideration of the comments outstanding, Staff recommends that the application be referred back to Staff for further processing.
