RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. THAT Report PD- 190-90 be received;
2 . THAT the Rezoning application submitted by Stephen Ward to create
four (4) additional estate residential lots be referred back to
staff to enable the applicant to submit an Official Plan amendment
and Plan of Subdivision application to the Region of Durham. A
subsequent report would be prepared pending receipt of all
outstanding comments with respect to these applications .
3 . THAT a copy of this Report and Council's decision be forwarded to
the Region of Durham Planning Department; and
4 . THAT the interested parties listed in this report and any
delegation be advised of Council's decision.
1. APPLICATION DETAILS

appropriate designation to create four (4)
additional estate residential lots .

2. BACKGROUND
2 . 1 In September of 1989 the Town of Newcastle received notice of four
Land Division applications (LD 656/89, LD 657/89, LD 658/89, LD
659/89) . These applications were submitted with the intent to
create four additional estate residential lots with access on a
proposed public road as shown on Attachment No. l.
2 .2 Staff comments to the Land Division Committee Meeting of Monday,
October 2, 1989, recommended that these applications be denied.
Staff recommended denial of these applications on the basis that
the creation of these lots did not comply to the Town's
Comprehensive Zoning By-law 84-63 .
2 . 3 The Land Division Committee tabled these applications at the
October 2, 1989, meeting to enable the applicants to resolve
outstanding issues with the Town of Newcastle and Central Lake
Ontario Conservation Authority.
2 .4 On March 26, 1990, the Town of Newcastle Planning and Development
Department received an application to rezone the subject site to
allow for the creation of four (4) additional estate residential
lots . The plans submitted are the same as those submitted to the
Land Division Committee in September of 1989 (Attachment No. 1) .
3. LOCATION
3 . 1 The subject site is located in Part Lot 14, Concession 2, in the
former Town of Bowmanville. The subject site is located on the
east side of Regional Road 57, north of Luverme Court.

4 . 1 Existing Uses: four (4) estate residential lots
4 .2 Surrounding Uses: East - Bowmanville Creek
West - Agricultural/Residential
South - Estate Residential
North - Agricultural/Residential . . . .3

5. PUBLIC SUBMISSIONS
5 . 1 No public submissions have been received at the time of the writing
of this report.
6. ZONING BY-LAW CONFORMITY
6 . 1 Within the Town of Newcastle Comprehensive Zoning By-law 84-63, the
subject property is zoned "Residential Estate (RE) " and
"Environmental Protection (EP) " . As the proposed use of the
subject property does not comply to the present zone provisions,
the applicant has applied to appropriately amend the zoning by-law
in order to permit the proposal.
7. OFFICIAL PLAN
7 . 1 The applicant has proposed the severance of four existing estate
residential lots (which predate the Durham Region Official Plan)
in order to create four additional estate residential lots on a
proposed public road as shown on Attachment No. 1. A limited
number of estate-residential developments may be permitted by
amendment to the Durham Region Official Plan, and shall occur by
registered plan of subdivision. The Town of Newcastle Planning and
Development Department has not received notice to date from the
Region of Durham of either an Official Plan amendment or
Subdivision application for the subject lands .
8. AGENCY COMMENTS
8 . 1 The subject application was circulated by the Town to various
agencies and departments to obtain comments . The following
agencies/departments offered no objection to the proposal:
Newcastle Community Services
Newcastle Fire Department
Newcastle Hydro Electric Commission
Ministry of Agriculture
Ministry of Natural Resources

8 .2 The Town of Newcastle Public Works Department object to this
proposal until such time as the applicant/owner submits an
application for a plan of subdivision.
8 . 3 The Central Lake Ontario Conservation Authority have noted concerns
regarding this proposal based upon existing erosion problems and
slope stability setbacks . The Authority further notes that it can
not support the approval of this application until their concerns
have been addressed by the applicant to their satisfaction.
8 .4 The Region of Durham Planning Department have verbally expressed
that the proposal would not comply to the Regional Official Plan
and that an Official Plan Amendment would be required to create
these additional estate residential lots.
8 .5 Comments have not been received to date from the following
agencies:
Public School Board
Separate School Board
Regional Works Department
Regional Health Department
Ministry of the Environment
9. CONCLUSION
9 . 1 As the purpose of this report is to address the requirements of a
Public Meeting under the Planning Act, and in consideration of the
comments outstanding, Staff recommends that the application be
referred back to Staff to enable the applicant to submit both
Official Plan Amendment and Subdivision applications to the Region
of Durham. Staff would prepare a subsequent report pending receipt
of all outstanding comments for the Official Plan Amendment and
Rezoning applications .
