RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1 . THAT Report PD-184-90 be received;
2 . THAT Rezoning Application DEV 87-11 submitted by Roger Cormier to
permit a taxi stand in addition to the existing uses be APPROVED;
3 . THAT the amending by-law attached hereto be passed;
4 . THAT a copy of this report and the amending by-law be forwarded
to the Region of Durham Planning Department;
5 . THAT the "H" - Holding symbol in the amending by-law will be
removed at such time the applicant has entered into site plan
agreement with the Town; and
6 . THAT the interested parties listed in this report and any
delegation be advised of Council's decision.

2 LOCATION
2 . 1 The subject property is the Newcastle Inn located in Part Lot 25,
Concession 1, Former Township of Clarke. The lands front on the
south side of Highway 2 immediately west of the Canadian Pacific
Railway overpass and north of the Graham Creek.
3 BACKGROUND
3 . 1 In February of 1987 the Planning Department received an application
for rezoning and site plan approval for the establishment of a taxi
stand in addition to the existing uses permitted on the above noted
site. The application was processed as per Town policy and
circulated to a number of commenting agencies .
3 . 2 In April of 1987 a report recommending approval of the subject
rezoning was forwarded to Committee. The report advised that the
only use permitted within the 1105-1" zone is a motel or motor
hotel . The report further commented that the establishment of a
taxi stand would not offend the intent of the Comprehensive Zoning
By-law. The recommendation therefore was to approve the
application to permit the taxi stand and a by-law forwarded to
Council once the Site Plan details had been revised to reflect the
new use.
3. 3 Since that time a couple of revisions have been made to the site
plan. The applicant and Staff are both now satisfied that the
amending zoning by-law can be passed allowing a taxi stand in
addition to the existing use.
4 CONCLUSION
4 . 1 That in consideration of Council's previous decision and the
comments contained within said report, the application be Approved
and the zoning by-law amendment attached hereto be passed.

THE CORPORATION OF THE TOWN OF NEWCASTLE
BY-LAW NUMBER 90-
being a By-law to amend By-law 84-63, the Comprehensive Zoning By-
law for the Corporation of the Town of Newcastle.
WHEREAS the Council of the Corporation of the Town of Newcastle
deems it advisable to amend By-law 84-63, as amended, of the
Corporation of the Town of Newcastle in accordance with DEV 87-11.
NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation
of the Town of Newcastle enacts as follows:
1. Section 20.4 "Special Exceptions - Special Purpose Commercial
(C5) Zone" of By-law 84-63, as amended , is hereby further amended
by adding the following new Subsection 20.4.8:
1120.4.8 SPECIAL PURPOSE COMMERCIAL EXCEPTION (C5-8) ZONE
Notwithstanding Section 20.1, those lands zoned 1105-8" on the
Schedules to this By-law may only be used for a motel or motor
hotel and taxi stand. The placement of buildings and
structures shall be subject to the regulations set out in
Section 20.2. "
2. Schedule "5" to By-law 84-63 as amended, is hereby further
amended by changing the zone designation from "Special Purpose
Commercial Exception (C5-1) " to "Special Purpose Commercial
Exception (C5-8) " Zone, as indicated on Schedule "A" attached
hereto.
3. Schedule "A" -shall form part of this By-law.
4. This By-law shall come into effect on the date of the passing
hereof, subject to the provisions of Section 34 of the Planning
Act.
BY-LAW read a first time this day of 1990.

BY-LAW read a third time and finally passed this day of
1990.
