RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. THAT Report PD-177 -90 be received;
2 . THAT the application to amend the Town of Newcastle
Comprehensive Zoning By-law 84-63, as amended, submitted by
Tunney Planning Inc . , on behalf of Ashdale Capital Corporation
Ltd. , be referred back to Staff for further processing and the
preparation of a subsequent report pending the receipt of all
outstanding comments; and
3 . THAT the interested parties listed in this report and any
delegation be advised of Council's decision.
1. APPLICATION DETAILS
1. 1 Applicant: Tunney Planning on behalf of Ashdale
Capital Corporation.
1.2 Rezoning: From in part "Urban Residential Type One
(Rl) " and in part "Environmental
Protection (EP) " to an appropriate zone
to permit the development of three (3)

single detached dwellings and eight (8)
semi-detached dwellings .
1. 3 Area: . 833 hectare (2 . 05 acre)
2. BACKGROUND
2 . 1 On April 5, 1990, the Town of Newcastle Planning and
Development Department received an application to amend the
Town of Newcastle Comprehensive Zoning By-law 84-63 in order
to permit the creation of three (3) single family dwellings
and eight (8) semi-detached dwellings .
2 .2 The subject site is a rectangular shaped parcel approximately
. 833 hectares (2 . 05 acres) in size and is located on the south
side of Concession Street East approximately 262 metres (862
feet) east of Hendry Gate, but is formally described as Part
Lot 9, Concession 1, in the former Township of Darlington.
3. PUBLIC NOTICE
3 . 1 For the Committee's information, pursuant to Council's
resolution of July 26, 1982, and the requirements of the
Planning Act, the appropriate signage acknowledging the
application was installed on the subject lands . In addition,
the appropriate notice was mailed to each land owner within
the prescribed distance.
3 .2 As of the writing of this report, the Planning and Development
Department has not received any public submissions with
respect to the subject application.

4. OFFICIAL PLAN CONFORMITY
4 . 1 Within the Durham Regional Official Plan, the subject property
would appear to be designated as a Residential Area.
Residential uses are intended to be the predominant use of
lands so designated.
4 .2 The Planning and Development Department note for the
Committee's information that the applicant is proposing to
create a municipal road allowance, three (3) single family
lots and eight (8) semi-detached/link lots through the consent
process . Section 16 .9 .4 of the Durham Regional Official Plan
states that "the Land Division Committee may consider three
additional lots as the maximum number of division by consent. "
However, since the Durham Regional Planning Department has yet
to respond to the circulation of the proposed zoning by-law
amendment, Staff are unable, at this time, to determine the
conformity of the application to the Durham Regional Official
Plan.
4 . 3 Within the Town of Newcastle Official Plan, the subject
property is located within the 1C Neighbourhood of Schedule
7-1 and is designated as Low Density Residential with an
indication of Hazard Land on a portion of the property. The
precise location of Hazard Land is to be determined through
comments from the Conservation Authority. The Town of
Newcastle Official Plan establishes a maximum density of 30
units per net residential hectare for Low Density Residential
Development. As the applicant is proposing the develop the
subject property at a density of 27 . 07 units per net
residential hectare, the application would appear to conform
with the Town of Newcastle Official Plan.

5. ZONING BY-LAW CONFORMITY
5 . 1 The Town of Newcastle Comprehensive Zoning By-law 84-63 zones
the subject property in part "Urban Residential Type One (R1) "
and in part "Environmental Protection (EP) " . As the applicant
is desirous of residentially developing that portion of the
subject property zoned "Environmental Protection" , the
applicant has applied to appropriately amend the zoning by-
law in order to implement the proposed development.
6. AGENCY COMMENTS
6 . 1 The Town of Newcastle Planning and Development Department
circulated the proposed zoning by-law amendment to various
agencies . The following provides a brief synopsis of comments
received to date.
6 .2 The Community Services Department has reviewed the subject
application and has no objection to the proposal subject to
the land dedication requirement being accepted as cash-in-lieu
on the basis of 1 hectare per 300 dwelling units with the
funds realized being credited to the Parks Reserve account.
6 . 3 The only other agency/department which has responded to the
circulation of the subject application is the Town of
Newcastle Fire Department which has no objection to the
proposal. The Town of Newcastle Public Works Department, the
Central Lake Ontario Conservation Authority, the Regional
Planning Department, the Regional Works Department and the
Ministry of Natural Resources have all yet to respond to the
circulation of the proposed zoning by-law amendment.

7. STAFF COMMENTS
7 . 1 As the purpose of this report is to satisfy the requirements
of the Planning Act with respect to a Public Meeting, and in
consideration of the outstanding comments, it would be in
order to have the application referred back to Staff for
further processing and the preparation of a subsequent report.
