THAT Report PD-160-90 be received for information. 2 . THAT application to amend the Town of Newcastle Comprehensive Zoning By-law 84-63, as amended, and to amend the Durham Regional Official Plan be referred back to Staff for further processing and the preparation of a subsequent report upon receipt of all outstanding comments; and 3. THAT the interested parties listed in this report and any delegation be advised of Committee and Council's decision. 1. APPLICATION DETAILS 1. 1 Applicant: Ridge Pine Park Inc . 1.2 OFFICIAL PLAN AMENDMENT: To increase population allocation from 1500 to an appropriate figure to permit development of 90 additional residential units in this the existing Wilmot Creek Retirement Community. _ . . .2 REPORT NO. : PD-160-90 PAGE 2 1. 3 REZONING: From Residential Mobile Home Park (RM) with a maximum density of 7 units per hectare to an appropriate zone to permit the above- noted development which would increase the density of the existing mobile home park to 7 . 75 units per hectare. 1 .4 AREA: 14 .5 hectares (35 .82 acres) 2 . BACKGROUND 2 . 1 On February 20, 1990, the Town of Newcastle Planning and Development received an application to amend the Town of Newcastle Comprehensive Zoning By-law in order to permit the development of 90 additional Residential Mobile Home Park lots, thereby increasing the overall density from 7 units per hectare to 7 . 75 units per hectare. 2 .2 On February 28, 1990, the Region of Durham advised the Town of Newcastle that the applicant had also applied to amend the Durham Regional Official Plan in order to implement the above-noted development. 2 . 3 The subject property is an irregular shaped 14 .5 hectare (35. 82 acres) parcel located in Part of Lots 1, 2 and 3, Broken Front Concession, Former Township of Darlington and Part of Lots 33, 34 and 35, Broken Front Concession, Former Township of Clarke. Approval of the application would permit the development of 90 additional residential units on the westerly portion of the subject property (Lot 3, Broken Front Concession, Former Township of Darlington) . 3 . PUBLIC NOTICE 3 . 1 For the Committee's information, pursuant to Council 's resolution of July 26, 1982 and the requirements of the Planning Act, the . . . 3 REPORT NO. : PD-160-90 PAGE 3 appropriate signage acknowledging the application was installed on the subject lands . In addition, the appropriate notice was mailed to each landowner within the prescribed distance. 3.2 As of the writing of this report, the Planning and Development Department has not received any written submissions with respect to the subject application. 4 . OFFICIAL PLAN CONFORMITY 4 . 1 Within the Durham Regional Official Plan the subject property is designated as a mobile home park with an R60 symbol. Section 8 . 1 . 3 . 11(2) of the Durham allocates a population of 1500 for the subject lands . 4 .2 As the applicant is desirous of developing approximately 90 additional units, the applicant has applied to appropriately amend the population allocation of the Durham Regional Official Plan in order to permit the proposal to be considered. 5 . ZONING BY-LAW CONFORMITY 5 . 1 Within the Town of Newcastle Comprehensive Zoning By-law 84-63, the subject property is zoned Residential Mobile Home Park (RM) . The implementing zoning by-law also stipulates that the density of the subject property is not to exceed 7 mobile homes per hectare. 5 .2 As the applicant is desirous of developing 90 additional mobile homes, thereby increasing the density from 7 units per hectare to 7 .75 units per hectare, the applicant has applied in order to appropriately amend the zoning by-law. 6 . AGENCY COMMENTS 6 . 1 The Town of Newcastle Planning and Development Department undertook a joint circulation of the Official Plan Amendment and Zoning By- � 16 . . .4 REPORT NO. : PD-160-90 PAGE 4 law Amendment. The following provides a brief synopsis of comments received to date. 6 .2 The Canadian National Railway has reviewed the subject applications and has no objection to its approval but notes that the applicant would have to comply with the Railway's standards for noise, vibration and safety. 6 . 3 The balance of the circulated agencies which have provided comments with respect to the subject applications are the Town of Newcastle Community Services Department, the Town of Newcastle Fire Department and the Ministry of Natural Resources . None of the aforementioned agencies have provided objectionable comments with respect to the subject application. The Town of Newcastle Public Works Department, the Regional Planning Department and the Regional Works Department have all yet to respond to the circulation. 6 .4 The Town of Newcastle Planning and Development Department notes for the Committee's information that should the application be approved, the development would be subject to the municipality's lot levy fees and the parkland dedication requirement as permitted by the Planning Act. 7 . STAFF COPMNTS 7 . 1 As the purpose of this report is to satisfy the requirements of the Planning Act with respect to a Public Meeting, and in consideration of the comments outstanding, it would be in order to have the application referred back to Staff for further processing and the preparation of a subsequent report.
