APPEAL TO LAND DIVISION COMMITTEE
FILE: LD 175/90 TO LD 178/90 INCLUSIVE
RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1 . THAT Report PD-157 -90 be received;
2 . THAT the Town of Newcastle appeals the decision of the Durham Land
Division Committee's approval of Applications A 175/90 to 178/90
inclusive on the basis of the reasons set out in this report;
3 . THAT the Secretary of the Region of Durham Land Division Committee
be advised of Council's decision on or before May 2, 1990 being
the last date of appeal .

1. 1 Applicant: John Vanginhoven
1.2 Land Severance: to create three (3) lots of approximately 3000
m2 each.

2 . BACKGROUND
2 . 1 In March of 1990, copies of Land Division Applications LD 175/90
to LD 178/90 were received by Staff for review and comment for Land
Division Committee's consideration at their meeting of Monday,
April 2 , 1990 .
2 .2 The applicant has resubmitted Land Severance applications on the
above-noted lands in an attempt to create four (4) lots . In 1987,
applications LD 620/87 to LD 623/87 were approved by the Committee,
subject to conditions . The applicant was unable to fulfil those
conditions and subsequently the approval period lapsed.
2 . 3 Since that time, the Town has initiated the Hampton Secondary Plan,
which outlines among other things, growth boundaries for the
Hamlet. Said Plan has received Town Approval and Regional Approval
(November 1989) and is currently before the Minister for approval.
The new Hamlet Plan did not include the subject lands within the
Hamlet boundaries. In addition, all new lots created within a
Hamlet shall have a minimum lot area of 4000 m2.
The application does not comply, as the lands are outside the
Hamlet boundaries .
2 .4 The lands are currently zoned "Residential Hamlet (RH) " within the
Town's Comprehensive Zoning By-law 84-63, as amended. The zoning
has not yet been amended to comply with the Official Plan
provisions. The "RH" zone requires 3000 m2 lot area minimum and
frontage of 30 m. In 1987 the applicant received approval from the
Committee of Adjustment to create four residential lots having
frontages of 28.5 m.

3 . CONCLUSION
3 . 1 The decisions of the Region of Durham Land Division Committee, is
contrary to the recently approved Hamlet Plan for Hampton and hence
should be appealed to the Ontario Municipal Board. It is noted
that the Regional Planning Staff are also not in support of these
land severance applications. Regional Planning Staff will be
recommending to Planning Committee that the decisions be appealed.
