PART LOT 26, CONCESSION 1, FORMER TOWNSHIP OF DARLINGTON FILE: OPA 89-112/D RECOMMENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PD-149 -90 be received; 2 . THAT the Official Plan Amendment application submitted by Wing Hang Corp. Ltd. to amend the Region Official Plan to redesignate the subject site industrial be recommended for DENIAL without prejudice to the Region of Durham. 3 . THAT the Region of Durham Planning Department and those persons listed in this report and any delegation be advised of Council's decision. 4 . THAT the Region of Durham Planning Department be forwarded a copy of Report PD- 149-90 , 1. APPLICATION DETAILS 1 . 1 Applicant: Wing Hang Corporation Ltd. 1.2 O.P.A. : From 'General Agricultural Reserve' to 'Industrial ' 1. 3 Area: 40 .20 ha (99 .23 acres) 5 () 9 /`I REPORT NO. : PD-149 -90 PAGE 2 2. BACKGROUND 2 . 1 On October 16, 1989, the Town of Newcastle was advised by the Durham Region Planning Department of an application submitted by Wing Hang Corporation Ltd. to amend the Durham Region Official Plan. 3. LOCATION 3 . 1 The subject site is located in Part Lot 26, Concession 1, in the former Township of Darlington. The subject site is located on the north side of Baseline Road, west of Solina Road. 4. EXISTING AND SURROUNDING USES 4 . 1 Existing Uses: Vacant - agricultural 4 .2 Surrounding Uses : East: Vacant - agricultural West: Vacant - agricultural South: Industrial North: Vacant - agricultural 5. PUBLIC SUBMISSIONS 5 . 1 No public submissions have been received to date with respect to this application. 6. OFFICIAL PLAN POLICIES 6 . 1 The applicant has proposed the redesignation of the subject site from 'General Agricultural Reserve' to 'Industrial' . The Region has recently presented the Draft Changes to the Durham Regional Official Plan, and these changes do not include the 599 9 _} REPORT NO. : PD- 149-90 PAGE 3 extension of the Courtice Industrial Area eastward to include the subject site. 6 . 2 The Region have proposed a 'Special Study Area' which would extend north of the present Courtice Industrial Area boundary to the southern limit of the Courtice Major Urban Area. The Region has indicated that further investigation is required to determine a suitable pattern of land use and municipal servicing requirements . This investigation of land use patters will include a review of future industrial areas within this study area. 7. SERVICING FEASIBILITY STUDY - SOUTH COURTICE AREA 7 . 1 On July 25, 1988 the Council of the Town of Newcastle directed Planning Staff to commence a Planning Study for the area south of Highway 401 between Darlington Provincial Park and the Darlington Generating Station. As part of the Study, Staff determined that the feasibility of servicing the Study Area with sanitary sewer and piped water services was a paramount consideration. Subsequently, the consulting firm of Totten Sims Hubicki were retained to commence a servicing feasibility study for areas 'A' through 'E' as shown on Attachment No. 1. 7 .2 On March 19, 1990, Staff presented the final results of the South Courtice Servicing Feasibility Study. One of the conclusions drawn by Totten Sims Hubicki was that development of the lands at the easterly end of Area 'B' (Attachment No. 1) which is currently designated Industrial, should be restricted due to difficulties in providing municipal water to these lands . The subject site is also constrainted by the water pressure zone boundary. 599 96 REPORT NO. : PD- 149-90 PAGE 4 8. AGENCY COMIMNTS 8 . 1 In accordance with departmental procedures, the subject application was circulated to various agencies and departments for their review and comment. The following agencies/departments offered no objections to the application: Town of Newcastle Community Services Town of Newcastle Fire Department Town of Newcastle Public Works Department Ministry of Natural Resources C.P. Rail 8 .2 The Ministry of Agriculture note that while consideration is given to the logical extension of an existing development, the need of this land for purposes other than agricultural uses must be justified and documented. Until the Ministry can review this information, the Ministry cannot support the proposed Official Plan Amendment. 8 . 3 The Central Lake Ontario Conservation Authority notes that until the issue of urban storm water runoff has been addressed for the Tooley Creek drainage area, we wish to reserve comment on development applications within the watershed. In view of the foregoing, C.L.O.C.A. considers this application premature. 8.4 Comments are still outstanding from the following agencies: Ministry of the Environment Regional Works Department 599 9 / REPORT NO. : PD-149 -90 PAGE 5 9. COMMENTS AND CONCLUSIONS 9 . 1 This application was submitted October 16, 1989, with the applicant's agent requesting that consideration be given to approval of the subject site for industrial development on full municipal services. The subject site however, falls outside of the pre-determined study boundaries for the South Courtice Servicing Feasibility Study. These study boundaries were adopted by Council July 25, 1988 . 9 .2 It has been the position of Staff and Council that further development of Industrial lands in South Courtice should proceed on full services . Since the subject site is outside of the area for servicing consideration, this application is considered premature in terms of servicing. 9 . 3 Furthermore, the South Courtice Servicing Feasibility Study presented a land use Scenario of 836 hectares (2065 acres) of industrial lands within Areas 'A' through 'E' , of which 186 hectares (459 acres) are presently designated industrial. This allows for the designation of 650 hectares ( 1606 acres) of additional industrial lands within the servicing study boundaries. The designation of additional industrial lands outside the servicing study boundaries would be unwarranted at this time. 9 .4 Finally, the subject site is located in the study area of the Ministry of Transportation North/South Freeway Connection Study. The development of a north-south connector freeway between Highway 401 and Highway 40 is considered vital to the overall functionality of the transportation system and to the Town's future. Alternative 2, as presented to Committee on July 3, 1989, passes in close proximity to the subject site. Approval of this application could jeopardize the actual alignment of this corridor. 599 98 REPORT NO. : PD- 149 -90 PAGE 6 9 .5 Given that this application can be considered premature both in terms of servicing considerations and in terms of the need for industrial lands, in addition to those industrial lands presented in the land use scenario of Report PD-106-90, it is recommended that the application submitted by Wing Hang Corporation Ltd. to amend the Durham Region Official Plan be recommended for DENIAL without prejudice to the Region.
