RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. THAT Report PD-148-90 be received;
2. THAT the Official Plan Amendment application submitted by 858372
Ontario Ltd. to amend the Region and Town Official Plan to
redesignate the subject site "Industrial" be recommended for DENIAL
without prejudice to the Region of Durham;
3 . THAT. the Region of Durham Planning Department and those persons
listed in this report and any delegation be advised of Council's
decision.
4. THAT the. Region of Durham Planning Department be forwarded a copy
of Report PD-148-90.
1. APPLICATION DETAILS
1.1 Applicant: 858372 Ontario Ltd.
1.2 Official Plan Amendment: From "General Agricultural Area" with an
indication of "Hazard Lands" to
"Industrial" .

2 . BACKGROUND
2. 1 On February 14, 1990, the Town of Newcastle was advised by the
Durham Region Planning Department of an application to amend the
Durham region Official Plan and Town of Newcastle Official Plan.
3 . LOCATION
3. 1 The subject site is located in Part Lot 27, Concession 1, in the
former Township of Darlington. The subject site is located on the
southeast corner of Bloor Street and Hancock Road (Attachment #1) :
4. EXISTING AND SURROUNDING USES
4. 1 Existing Uses: vacant - agricultural

4.2 Surrounding Uses:
East: vacant - agricultural
West: vacant - agricultural
South: vacant - agricultural
North: residential
5. PUBLIC SUBMISSIONS
5. 1 Written submissions were received from Dale and Janet Coolidge,
Terrance and Diana Reid and William Reid.
5.2 Dale and Janet Coolidge oppose this application on the basis that
there is not a need for more industrial, given the number of vacant
industrial parcels along Baseline Road. Furthermore the Coolidges
feel that the extension of services to these lands would not be
justified.
5.3 Terrance and Diana Reid oppose this application because they f
believe that industrial development on this site would create a
discontinuity of land uses in this area. . . . .3

5.4 William Reid opposes this application and believes that the
Regional Official Plan should be upheld, and that those areas
designated agricultural should remain agricultural.

6 . OFFICIAL PLAN POLICIES
6 . 1 The applicant has proposed the redesignation of the subject site
l from "General Agricultural Reserve" to "Industrial" . The Region
has recently presented the Draft Changes to the Durham Regional
Official Plan. The Region have proposed a--- "Special .Study Area"
which would extend north of the present Courtice Industrial Area
boundary, west of Courtice Road, to 'the southern limit of the
Courtice Major Urban Area. The Region has indicated that further
investigation is required to determine a suitable pattern of land
use and municipal servicing requirements. This investigation of
land use patterns will include a review of future industrial areas
within this study area.

7 . SERVICING FEASIBILITY STUDY - SOUTH COURTICE AREA
7 . 1 The consulting firm of Totten Sims Hubicki was engaged by the Town
to conduct a servicing feasibility study for the South Courtice
area, specifically Areas "A" through "E" as shown on Attachment No.
2 .

7 .2 On March 19, 1990, Staff presented the final results of the South
jCourtice Servicing Feasibility Study. The subject lands are .
indicated in the pressure zone 2. It could eventually be serviced
by trunk sanitary sewer services in the Tooley Creek drainage area
and by the extension of the water services along Bloor Street
should the proposed servicing scheme be implemented.
8. AGENCY COMMENTS

8. 1 In accordance with departmental procedures, the application was

circulated to obtain comments from other departments and agencies.
8.2 The Town of Newcastle Fire Department has no objection to this
application.
8.3 The Ministry of Agriculture note that while consideration is given
to the extension of an existing development, the need of this land
for purposes other than agricultural uses must be justified and
documented. Until the Ministry can review this information, the
Ministry cannot support the Official Plan Amendment.
8.4 The Ministry of Natural Resources has no objection to the majority
of the site being redesignated to "Industrial" provided that the
"Hazard" category remains on the Tooley Creek tributary.
8.5 The Central Lake Ontario Conservation Authority notes that until
the issue of urban storm water runoff has been addressed for the
Tooley Creek drainage area, they consider this application
premature.
8.6 Comments are still outstanding from the following
agencies/departments:
- Town of Newcastle Public Works Department
- Town of Newcastle Community Services Department
- Regional Works Department
- Ministry of the Environment
9 . COMMENTS AND CONCLUSIONS
9 .1 This application was submitted February 14, 1990, ' with the
applicant's agent requesting that consideration be given to
approval of the subject site for industrial development on full
municipal services. The subject site however, falls outside of the
predetermined study boundaries for the South Courtice Servicing
Feasibility Study. There study boundaries were adopted by Council
on July 25, 1988.

1 9 .2 It has been the position of Staff and Council that further
1 development of Industrial lands in South Courtice should proceed
on full services . S. nce the subject site is outside of the area
for servicing consideration, this application is considered
I
premature in terms of servicing.
9 .3 Furthermore, the South Courtice Servicing Feasibility Study
presented a land use scenario of 836 hectares (2065 acres) of
industrial lands within areas "A" through "E" , of which 186
hectares (459 acres) are presently designated- industrial.. This
allows for the designation of 650 hectares. (1606 acres) of
1 additional industrial lands within the servicing study boundaries.
The designation of additional industrial lands outside the
servicing study boundaries would be unwarranted at this time.
9 .4 Finally, the subject site is located in the study area of the
Ministry of Transportation's North/South Freeway Connection Study.
The development of a north-south connector freeway between Highway
401 and Highway 407 , is considered vital to the overall
functionality of the transportation system and to the Town's
I future. Alternative 2, as presented to Committee on July 3, 1989,
passes in close proximity to the subject site. Approval of this
japplication could jeopardize the actual alignment of this corridor.
9 .5 Given that this application can be considered premature both in
terms of servicing consideration and in terms of the need for
I industrial lands, in addition to those industrial lands presented
I in the land use scenario of Report PD-106-90, it is recommended
that the application submitted by 858372 Ontario Ltd. to amend the
Town and Region Official Plan be recommended for DENIAL without
prejudice to the Region.
