RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. THAT Report PD-145 -90 be received;
2 . THAT the Region of Durham be requested to approve a Special
Exception to the Durham Regional Official Plan to permit the
development of Subdivision Application 18T-86017 as submitted
by Mr. Aleck Moffat in Part Lot 27 , Concession 4, former
Township of Clarke; and
3 . THAT a copy of this report and Council 's decision be forwarded
to the Region of Durham Planning Department; and
4 . THAT the interested parties listed in this report and any
delegations be advised of Council 's decision.
1. BACKGROUND
1. 1 Subdivision Application 18T-86017, submitted by Mr. Aleck
Moffat in March 1986, proposes to create 10 residential lots
on a 3 .96 ha (9 .79 acre) parcel located in Part Lot 27 ,
concession 4, former Township of Clarke. The lots are
proposed to be privately serviced. The subject site lies to
the east of Highway 35/115 and has, been severed from the

applicant's lands by the new exit ramp connecting the highway
to the Sommerville Drive extension (see Attachment No. 1) .
1.2 In October 1986, the Town recommended draft approval of the
subject subdivision application on the basis that it
constitutes a minor addition to existing development in the
hamlet of Orono. As well, the proposed subdivision would have
little impact on the development potential of Orono inasmuch
as it would not utilize capacity in the municipal water
system.
Revised subdivision plans were submitted in April 1987 and
again in March 1988 . This latter revision essentially
reflected the initial submission made in 1986 . The Town
recommended draft approval of the last revision in July 1988 .
1. 3 Rezoning Application DEV 86-55 also submitted by Mr. Moffat
to rezone the subject site to 'Residential Hamlet (RH) ' was
approved in principle by Council on November 25, 1986 .
1.4 The Region of Durham Planning Department has indicated that
the subject site cannot be construed as being part of Orono,
not withstanding its proximity to the existing built-up area
of the hamlet. The preparation of a Development Plan for the
Hamlet of Orono is a pre-requisite for the Region's evaluation
of the development proposal.
2. ORONO SECONDARY PLAN
2 . 1 The Orono Secondary Plan as prepared by Proctor and Redfern
and as recommended for approval by Staff indicates the subject
subdivision plan as being outside the hamlet boundaries . The
consultant, in recommending that Highway 35/115 form the
eastern boundary of the hamlet, noted that the Ministry of

Agriculture and Food had expressed a concern with the
expansion of the hamlet onto high quality agricultural soils .
The Ministry, therefore, recommended that development not be
considered east of Highway 35/115 as it provides a strong
physical boundary to development.
2 .2 The consultant further noted that the Region of Durham Works
Department had indicated, in commenting on the Orono Secondary
Plan, that further development in Orono should only proceed
on the basis of municipal water. Additional development on
private systems should be discouraged within the hamlet area
in order to avoid pressure for full urban services in the
future.
2 . 3 Accordingly, the consultant recommended that the Town consider
withdrawing its recommendation of draft approval on the
subject subdivision application or, alternatively, that the
plan be recommended to the Region for approval as an exception
outside the hamlet area.
3. CONCLUSION AND RECOMMENDATIONS
3 . 1 In reviewing Proctor and Redfern's final report on the Hamlet
of Orono Secondary Plan, Staff concur with the consultant's
position on a strong definable eastern boundary to the hamlet
at Highway 35/115 . A more compact form to the hamlet is
desirable to minimize intrusion into agricultural areas. As
well, the provision of municipal services to the subject
subdivision is highly unlikely. Therefore, consideration of
the Moffat application within the context of the Secondary
Plan would contradict the premise on which the Orono Plan was
developed, that being the establishment of the firm hamlet
boundary and the provision of municipal water services to new
development.

3 .2 In this regard, however, Staff note that the Town has twice
recommended draft approval of the subject subdivision
proposal, most recently in July 1988 and has approved the
rezoning application in principle. The subject applicaton
represents a special circumstance in that the site is
completely surrounded by public roads and is therefore
isolated from the agricultural community. As well, an
existing cluster of non-farm residential lots, which is
recognized in By-law 84-63, lies directly to the north.
As well, the applicant has endeavoured to address the concerns
identified through the circulation of the subdivision
application.
3. 3 It is therefore recommended that the Region be requested to
approve a Special Exception to the provisions of Durham
Regional Official Plan to permit the proposed subdivision.
