ZONDERVAN PART LOT 13, CONCESSION 7, FORMER TWP. OF CLARKE RECOMMENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PD-119-90 be received; 2 . THAT the Official plan Amendment application submitted by Mr. Zondervan to amend the Regional Official Plan to permit two (2) non-farm residential lots be recommended for DENIAL to the Region of Durham; and 3 . THAT the Region of Durham Planning Department and those persons listed in this report and any delegation be advised of Council 's decision. 1 . APPLICATION DETAILS: 1. 1 Applicant: Mr. Zondervan 1.2 Owner: Mr. Zondervan 1. 3 O.P.A. : From: "Permanent Agricultural Reserve" to an appropriate designation to permit the development of two (2) non-farm residential lots. 1 .4 Area: 0 . 8 hectares (2 acres) . . .2 � f REPORT NO. : PD- 119-90 PAGE 2 2 . LOCATION: 2 . 1 The subject property is located in Part Lot 13, Concession 7, former Township of Clarke. It fronts onto Stapleton Road approximately 106 m (350 ft. ) north of Highway No. 2 . 3 . BACKGROUND: 3 . 1 On August 14, 1989, the Town of Newcastle Planning Department received notification that Mr. Zondervan had submitted an application to amend the Durham Regional Official plan to permit two (2) non-farm residential lots . 4 . EXISTING AND SURROUNDING USES: 4 . 1 Existing Uses: Vacant 4 .2 Surrounding Uses: East: Farm West: Farm South: Existing Residential Lot & Hwy.2 North: Farm 5 . OFFICIAL PLAN POLICIES: 5 . 1 Within the Durham Region Official Plan, it appears that the property in question is designated "Permanent Agricultural Reserve" . Section 11.2 .2 of the Durham Region Official plan states that lands designated "Permanent Agricultural Reserve" shall be used for only agriculture and farm-related uses . In addition, Section 11.2 .5 states that "non-farm residences. . . shall not be permitted in those areas designated "Permanent Agricultural Reserve" . " 5 .2 In addition, Staff note that this application does not comply with the "Rural Cluster" policies as stated in Section 10 .2 . 1. 3 of the Durham Regional Official Plan. . . . 3 4 REPORT NO. : PD- 119-90 PAGE 3 5 . 3 This application does not comply with the intent of the Durham Region Official Plan with regard to rural area policies. Consequently, the applicant is applying for a site specific exemption from the Plan's provisions. 6 . ZONING: 6 . 1 The Town of Newcastle Comprehensive Zoning By-law 84-63 zones the subject site "Agricultural Exception (A-1) " . Lands so zoned shall be primarily used for agriculture and farm-related uses . 7 . PUBLIC NOTICE AND SUBMISSIONS: 7 . 1 Pursuant to Council's resolution of July 26, 1982 and the requirements of the Planning Act, the appropriate signage acknowledging the application was installed on the subject lands . As of the writing of this report, no written submissions or verbal inquiries have been received. 8 . AGENCY COMMENTS: 8 . 1 In accordance with Departmental procedures, the application was circulated to obtain comments from other departments and agencies . The following departments/agencies in providing comments, offered no objection to the application as filed: - Town of Newcastle Fire Department - Town of Newcastle Public Works Department - Durham Regional Works Department - Durham Regional Health Unit - Ganaraska Region Conservation Authority - Ministry of Natural Resources . . .4 X65 REPORT NO. : PD-119 -90 PAGE 4 8 .2 The Town of Newcastle Community Services Department had no objection to this application, however, they did request that the applicant provide a 5% parkland dedication to be accepted as cash-in-lieu. 8 . 3 The Ministry of Agriculture and Food noted that the site is situated in an area where farm uses predominate, and that the soils north of Highway No. 2 have an "Agricultural rating of 80% Class 1 and 20% Class 4 with topography limitations" . Hence, this Ministry objected to this application as it does not conform with the "Food Land Guidelines" . 9 . STAFF COMMENTS: 9 . 1 The subject property is surrounded by large farms being approximately 50 acres, 200 acres, and 255 acres respectively. Staff believe that the inclusion of non-farm related residential lots in this area will not be in character with the surrounding landuses and negatively impact the long term agricultural potential use of these lands . This application does not comply with the intent of the Durham Regional Official Plan or the "Food Land Guidelines" . Staff do not feel that this application warrants any special exemption from the provisions of the Durham Region Official Plan. 10.
