THAT Report PD-124 -90 be received; 2 . THAT the Region of Durham be advised that the Town of Newcastle has no objection to Official Plan Amendment Application 89-110/0 submitted by Cramac Investments to permit the establishment of a medical clinic on King Street East in the City of Oshawa; and 3 . THAT a copy of this report and Committee's and Council's decision be forwarded to the Region of Durham Planning Department and the City of Oshawa Planning Department. 1. BACKGROUND 1. 1 On October 5, 1989, the Town was advised by the Region of Durham of an application to amend the City of Oshawa Official Plan. The Town's comments on the application were requested. 2. APPLICATION DETAILS 2 . 1 Owner/Applicant: Cramac Investments Ltd. 579 05 REPORT NO. : PD- 12490 PAGE 2 2 .2 Proposed Use: Two Storey Medical Clinic with 1288 sq. metres (13,860 sq. feet) of floor space. 2 . 3 Location: 1226 King Street East, Oshawa; approximately 370 metres (1214 feet) west of the Oshawa/Newcastle Townline on the north side of King Street (see Key Map) . 2 .4 Area of Site: 0 .33 ha (0. 82 acres) 3. EXISTING AND SURROUNDING USES 3. 1 Existing Use: Single family dwelling 3 .2 Surrounding Uses: North - Harmony Creek and Kingsway College South - Residential East - 3 storey retirement home and Kingsway Village Mall West - Residential 4., OFFICIAL PLAN POLICIES 4 . 1 The subject site is designated "Residential" by the City of Oshawa Official Plan and is located within the Community Central Area centred on the Kingsway Village Mall at Townline Road and Highway 2 . 4 .2 The City of Oshawa Official. Plan permits Community Central Areas, as a general guideline, to develop a maximum of 14,000 sq. metres (150,700 sq. feet) of retail and personal service 599 06 REPORT NO. : PD- 124-90 PAGE 3 floor space. The Official Plan also states that limited office, retail and personal service floor space may be permitted as an exception within areas designated as "Residential" , provided such uses are compatible with surrounding land uses . The Official Plan also provides for the preparation of Part II Plans for Community Central Areas in order to redefine boundaries where appropriate and to provide detailed land use designations and related policies. A Part II Plan has not been prepared for the Kingsway Community Central Area. 4 . 3 An Official Plan Amendment is being required for the proposed medical clinic for the following reasons: the Kingsway Community Central Area currently has 15,330 sq. metres ( 165,000 sq. feet) of retail and personal service floor space, thereby exceeding the guidelines established by the Official Plan; the floor area of the proposed use is not limited in scale as required by the Official Plan for lands designated Residential. 5. STAFF COMONTS 5 . 1 In the absence of a Part II Plan for the Kingsway Community Central Area, the development of the proposed medical clinic could be considered premature. However, Staff note that the maximum retail and personal service floor space indicated by the Official Plan for Community Central Areas is only intended as a guideline. In that regard, the proposed clinic does not represent a significant increase over the allocated commercial floor space. City of Oshawa Planning Staff have also advised 599 OI REPORT NO. : PD-124 90 PAGE 4 of their intention to limit non-office uses in the proposed building to a medical lab and a dispensary for prescriptions. A full-service drugstore will not be permitted. 5.2 Given the site's proximity to higher density residential uses, institutional and major commercial uses, Staff feel that the proposed development is an appropriate use for the area. A medical clinic is one of the uses staff have been promoting through the Courtice West Highway No.2 Corridor Study. 6. CONCLUSION 6 . 1 The proposed medical clinic does not represent a significant increase over the commercial square footage allocated to the Kingsway Community Central Area. It is recommended that the Region be advised that the Town has no objection to the subject Official Plan Amendment Application.
