RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. THAT Report PD-81-89 be received;
2 . THAT application to amend the Town of Newcastle Official Plan and
Comprehensive Zoning By-Law, as amended, submitted by Paul and Lisa
Langley, be referred back to Staff for further processing and the
preparation of a subsequent report upon receipt of all outstanding
comments; and
3 . THAT the interested parties listed in this report and any
delegation be advised of Council's decision.

2 . LOCATION
2 . 1 Legal Description: Part Lot 17, Concession 10, former Township of
Darlington.
2 .2 Relative Location: bordering on the eastern boundary of the Hamlet
of Burketon on the west side of Regional Road
57 and bounded by Concession Road # 10 on the
south, and the Canadian Pacific Railway on the
north.
3 . BACKGROUND
3 . 1 The Town of Newcastle Planning and Development Department were
circulated an Official Plan Amendment for comment in December 1989 .
The applicant is seeking to amend the Burketon Station Hamlet Plan
(Schedule 9-2) to allow the development of three (3) residential
lots through the consent process.
3.2 The application to amend the Comprehensive zoning By-Law was made
on December 5, 1989 by Mr. P. Langley. This application was to
permit the development of three additional lots for single detached
dwellings.

5. 1 Durham Region Official Plan
The subject site appears to be designated as "Major Open Space- Oak
Ridges Moraine" . The predominant use of lands so designated shall
be for agricultural and farm related purposes. Residential
development shall be limited to minor internal infilling and/or
minor additions to existing development provided that such
development is recognized as a Residential Node or Cluster in the
local municipality's Zoning By-lay. Furthermore, the subject
property is located outside of the limits of the Burketon Station
Secondary Hamlet Plan. Therefore, the applicant applied in December
of 1989 to amend the Burketon Station Hamlet and this application,
in view of the current policies, is now being considered as an
amendment to the Town of Newcastle Official Plan.
6 . ZONING
6 . 1 The subject lands are currently zoned "Agricultural (A) " By-law
84-63, in the Town of Newcastle Comprehensive Zoning By-law. As
residential uses of the size and magnitude proposed in the subject
application are not permitted within the current zone category, the
applicant has also applied to appropriately amend the Zoning By-
law.
6 .2 The proposed rezoning application would change the zoning to an
appropriate category to permit the proposed development. . . .4

7 . PUBLIC NOTICE
7 . 1 Pursuant to the requirements of the Planning Act and Council
policy, notice of the Public Meeting with respect to the subject
rezoning amendment submitted by Paul and Lisa Langley was mailed
to all property owners with 120m (394) of the subject site. In
addition, the appropriate signage acknowledging the application
was installed on the subject lands .
7 .2 As of writing this report, no written submissions have been
received.
8 . COMMENTS FROM AGENCIES
8 . 1 The Official Plan Amendment has been circulated by Regional
Planning Staff to a number of agencies, including the Town of
Newcastle. Staff undertook a similar circulation to the appropriate
agencies and departments for the Zoning By-law Amendment
application. The following departments/agencies in providing
comments, offered no objection to the application as filed:
- Town of Newcastle Fire Department
- Durham Regional Health Department
- Ministry of Agriculture and Food
- Peterborough-Victoria-Northumberland and Newcastle Roman
Catholic School board

8 .2 Staff notes that the Town of Newcastle Community Services
Department requested that the 5% park land dedication be accepted
as cash-in-lieu.
8 . 3 The Town of Newcastle Public Works Department asked that the
Applicant will bear the cost ( 100%) of any works on Concession
Road 10 which are necessitated as a result of this development and
that monetary contributions are made to the
reconstructing/upgrading of Concession Road # 10 (45m x $152 .00/m
_ $6,840. 00) . The Public Works Department also asked that an
application for property access be made.
8.4 The Ministry of Natural Resources noted no objection to the
application in principal, however advised that the subject
property, located on the west side of Regional Road #57, is
directly west of a licensed gravel pit operation on the east side
of Regional Road #57 . The Ministry also noted that in its current
undeveloped state, the subject property acts as a natural buffer
zone between the existing extraction operations and the residential
development in the Hamlet of Burketon. This buffer helps to
mitigate impacts associated with the aggregate operation. The
Ministry further noted that the proposed residential development
would increase the potential for conflicts between these two land
uses .

8.5 Comments remain outstanding from the following agencies :

-Northumberland and Newcastle Board of Education
-Ontario Hydro
9 . STAFF COMMENTS
9 . 1 Staff would note that the proposal is to be reviewed with respect
to the policies of the Durham Region Official Plan. Section
10.4 . 1.2 of the Durham Region Official Plan designates the Hamlet
of Burketon Station as a Hamlet for growth up to a total of 150
residential units . In addition, Section 10.4 . 1. 3 states that
Hamlets should develop in depth rather than in strips .
9 .2 Staff note that the lands front on to Regional Road # 57, a Type
A arterial road in the Durham Region Official Plan. According to
Sections 13 .2 .7 and 13 .2 . 14, Arterial roads are designed primarily
as limited access roads and the maximum number of private access
points to Type A arterial roads in rural areas shall generally be
limited to 2 per side per mile. Additionally, the elevation of the

subject lands varies from the existing road grade. The comments of
the Region of Durham Works Department have been requested to
address the overall proposal.
10 . CONCLUSION
10 . 1 As the purpose of this report is to address the requirements of a
Public Meeting under the Planning Act, Staff recommends the
application be referred back to Staff for further processing.
