RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. THAT Report PD- 82 -90 be received;
2 . THAT application to amend the Town of Newcastle Comprehensive
Zoning By-law 84-63, as amended, submitted by Irwin Hamilton on
behalf of 621182 Ontario Limited be referred back to Staff for
further processing and the preparation of a subsequent report upon
receipt of all outstanding comments; and
3. THAT the interested parties listed in this report and any
delegation be advised of Council's decision.
1. APPLICATION DETAILS
1. 1 Applicant: 621182 Ontario Limited
1.2 Rezoning Application: from "Agricultural (A) " to an appropriate
zone to permit residential development.
1. 3 Land Severance Application: to permit the creation of five (5)
12 . 0 metre (40 ft) single family
dwelling lots .
1.4 Land Area: 0. 303 Ha (0 .748 Acres) . . .2

2. BACKGROUND
2 . 1 An application was received by the Town of Newcastle Planning and
Development Department on November 23, 1989, proposing to rezone
a 0 . 3 Ha parcel of land abutting Mearns Ave to allow for the
development of five (5) single family dwelling lots . The proposed
lands are bounded on three sides by lands which previously received
Draft approval for proposed plan of subdivision ( 18T-89013) . The
plan of subdivision proposes a road accessing Mearns Avenue,
abutting the subject lands on the north boundary (see attached) .
2 .2 The applicant has also submitted an application to the Land
Division Committee which was heard on January 22, 1990 . The
proposed severance was TABLED at said meeting to allow the
applicant to meet with Town Planning Staff. Staff recommended the
application be TABLED until such time the proposed Plan of
subdivision is developed, otherwise the proposed lots would be
landlocked.
3 LOCATION
3 . 1 The subject property is located in Pt. Lt. 9, Conc. 2, former Town
of Bowmanville and has approximately 45 . 0 metres frontage on Mearns
Ave. It is north of Concession St. , south of the Canadian Pacific
Railway, east of Bradshaw Street and west of mearns Avenue.
4 EXISTING AND SURROUNDING USES
4 . 1 Existing uses on the site include a single family dwelling and an
old barn, these are both proposed to be removed should development
take place. Surrounding land uses include to the north, south and
west vacant lands which now comprise a Draft Approved Plan of
Subdivision 18T-89013 and to the east vacant lands which are
subject of a Town Approved Plan of Subdivision 18T-88037 . . . . 3

5. 1 Pursuant to Council's resolution of July 26, 1982 and the
requirements of the Planning Act, the appropriate signage
acknowledging the application was installed on the subject lands.
In addition the appropriate notice was mailed to each landowner
within the prescribed distance.
As of the writing of this report, no written submissions have been
received.
6 OFFICIAL PLAN POLICIES
6 . 1 Within the Durham Regional Official Plan the subject property is
designated 'Residential' . The residential policies allow
development of housing and encourage a variety of type and style.
The application would appear to comply.
6 .2 Within the Town of Newcastle Official Plan, Bowmanville Major
Urban Area, the subject lands are within neighbourhood 11D' and
designated 'Low Density Residential' . Said policies allow
residential development to a maximum density of 30 units per net
ha, however the application must comply with the population target
of 5000 . The application would appear to comply.
7 AGENCY COMMENTS
7 . 1 The subject application was circulated to a number of agencies and
departments for comment. To date a number of agencies have yet to
respond these include: the Newcastle Hydro Electric Commission; the
Central Lake Ontario Conservation Authority; the Northumberland
Newcastle Public School Board; Regional Planning; and Regional
Public Works .
7 .2 Three of the agencies which have provided comments to date stated
unconditional no objections to the application as circulated to

them. These include the Peterborough Victoria Northumberland and
Newcastle Separate School Board; the Regional Health Department
and the Ministry of Natural Resources Staff.
7 . 3 The Town of Newcastle Public Works Department advised that the
application was premature until the Town has entered into an
agreement with the developer of the abutting draft approved plan
of subdivision 18T-89013 and the roadways are constructed within
the said plan to provide access to the proposed five (5) lots .
7 .4 The Newcastle Fire Department indicated the subject site falls
within the recognized response area of Station # 1, Bowmanville
and is expected to have a response time of approximately 6 to 8
minutes .
7 .5 The Newcastle Community Services Department provided no objection
to the subject application, provided that the five percent (5%)
park land dedication be received as cash-in-lieu.
8 STAFF COMMENTS
8. 1 The subject application is considered an infilling situation in as
much as the surrounding lands have received previous approvals and
are awaiting Subdivision Agreement. The proposed lots would have
direct access to the Apple Blossom Boulevard extension at such time
as it is constructed. Apple Blossom Blvd. is designated as a
collector road in Schedule 7-1 of the Newcastle Official Plan.
Policies regarding collector roads outline the function of such
roads in the movement of traffic, and suggest where possible
limited access should be permitted.
8.2 The proponent is proposing to develop five (5) 12 .0 metre minimum
frontage lots accessing Apple Blossom Blvd. The Draft Approved
Plan of Subdivision proposes 15 . 0 metre minimum frontage lots
directly across the street from the subject lands. Staff suggest

the application be revised to illustrate 15 .0 metre frontage lots.
This would reduce the number of potential lots from five to four
(4) , and would be in keeping with the approved lots to the north;
it would better reflect the policies relating to collector roads
and would cause less congestion in proximity of a major
intersection (Mearns\Apple Blossom) .
8 . 3 The Public Works comments stated that the application is premature
until such time as the Town has entered into a subdivision
agreement with the owner of the surrounding lands ( 18T-89013) and
the roadway has been constructed. Planning Staff agree with said
comments noting that should the rezoning and consent applications
be approved prior to the construction of the roadway, the proposed
lots would be land locked.
8 .4 The proponent of the subject rezoning and land severance
applications is also the owner of the abutting approved plan of
subdivision. In order to expedite the approval process for the
applicant, Staff suggest the applicant should approach Regional
Planning Staff with regards to amending the Draft Approved Plan of
Subdivision to include the subject lands . Otherwise, said
application cannot be dealt with through the consent process until
the Subdivision Agreement has been entered into and the roadway
constructed.
9 CONCLUSION
9 . 1 The purpose of this report is to facilitate the Public Meeting as
required by the Planning Act, to provide Committee and Council with
some background on the application submitted and for Staff to
indicate areas of concern regarding the subject application.
