General Purpose and Administration Committee DATE: March 19, 1990 REPORT #: PD- 98 -90 FILE #: DEV 90-009 SUBJECT: REZONING APPLICATION — PART LOT 13, CONCESSION 1, FORMER TOWN OF BOWMANVILLE MICHAEL ZYGOCKI RECOMMENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PD- 98-90 be received; 2 . THAT application to amend the Town of Newcastle Comprehensive Zoning By-law 84-63, as amended, submitted by Michael Zygocki Limited on behalf of Pedan Enterprises Ltd. and D'Angelo (P&G) Homes Limited, be referred back to Staff for further processing and the preparation of a subsequent report upon receipt of all outstanding comments; and 3. THAT the interested parties listed in this report and any delegation be advised of Council's decision. 1. BACKGROUND 1. 1 Applicant: Michael Zygocki Limited 1.2 Owner: Pedan Enterprises Ltd. and D'Angelo (P&G) Homes Limited 1. 3 Rezoning: From - Urban Residential Type One (R1) To - an appropriate zone to permit 18 link townhouse dwellings 1.4 Area: 0 .48 ha ( 1. 18 acres) . . .2 yC REPORT NO. : PD- 98 -90 PAGE 2 2. LOCATION 2 . 1 The subject property is located in Part Lot 13, Concession 1, former Town of Bowmanville. This parcel is further defined as being located on Quinn Drive directly east of the existing retail/commercial plaza fronting on Waverly Road. 3. BACKGROUND 3 . 1 On January 24, 1990 the Town of Newcastle Planning Department received an application to amend the Town of Newcastle Comprehensive Zoning By-law 84-63 as amended, to permit the development of 18 link townhouse units . 4. EXISTING AND SURROUNDING USES 4 . 1 Existing Uses: Vacant 4 .2 Surrounding Uses: East - Existing Residential West - Existing Retail Plaza South - School/Park North - Existing Residential 5. OFFICIAL PLAN POLICIES 5 . 1 It appears that the subject property is designated "Low Density Residential" in the Town of Newcastle Official Plan. This designation does not permit development to exceed a density of 30 units per net residential hectare. This particular application has a density of 37 .5 units per hectare. The applicant has been advised that an Official Plan Amendment is required. 6. ZONING 6 . 1 The property is presently zoned "Urban Residential Type One (R1) " which does not permit the development of townhouses. . . .3 0 REPORT NO. : PD- 98 -90 PAGE 3 7. PUBLIC MEETING AND SUBMISSION 7 . 1 Pursuant to Council's Resolution of July 26, 1982 and the requirements of the Planning Act the appropriate signage acknowledging the application was installed on the subject lands . In addition, the appropriate notice was mailed to each landowner within the prescribed distance. As of the writing of this report, no written submissions have been received. 8. AGENCY COMMENTS 8. 1 In accordance with departmental procedures, the application was circulated to obtain comments from other departments and agencies . The following departments/agencies in providing comments, offered no objection to the application as filed: Town of Newcastle Fire Department Peterborough-Victoria-Northumberland and Newcastle Roman Catholic Separate School Board 8 .2 The Town of Newcastle Community Services Department has no objection to this proposal, however, they do request that cash-in-lieu of parkland be accepted on the basis of 1 ha per 300 dwelling units . 9. STAFF COMMENTS 9 . 1 Staff notes that the applicant has been advised that an Official Plan Amendment is required. At the time of writing this report, the Town has yet to receive notice from the Region that an application to amend the Official Plan has been submitted. . . .4 REPORT NO. : PD-98 -90 PAGE 4 10. CONCLUSION As the purpose of this report is to satisfy the requirement for a Public meeting under the Planning Act, and in consideration of the numerous agency comments outstanding, it is recommended that the application be referred back to Staff for further processing.
