THAT Report PD- 50 -90 be received; 2 . THAT application to amend the Town of Newcastle Comprehensive Zoning By-law 84-63, as amended, submitted by Hoddenbagh, Horton and Associates on behalf of Jean Canty and Russell Saunders be referred back to Staff for further processing and the preparation of a subsequent report upon receipt of all outstanding comments; ' and 3. THAT the interested parties listed in this report and any delegation be advised of Council 's decision. 1. APPLICATION DETAILS: 1. 1 Applicant: Hoddenbagh, Horton & Associates 1.2 Owner: Jean E. Canty and Russell G. Saunders 1. 3 Subdivision: 12 single family lots 1.4 Rezoning: From: "Agricultural (A) " To: an appropriate zone to permit the proposed development 1.5 Area: 3 . 172 ha (7 .8 ac) . . .2 REPORT NO. : PD- 50 -90 PAGE 3 Plan permits residential development on lands so designated subject to various provisions including the availability of municipal water supply. 6 . ZONING: 6 . 1 According to the Town of Newcastle Comprehensive Zoning By-law 84- 63, as amended, the subject lands are designated "Agricultural (A) " . The predominant use of lands so zoned shall be for agriculture and farm-related uses. 7 . PUBLIC MEETING AND RESPONSE: 7 . 1 Pursuant to Council's resolution of July 26, 1982 and the requirements of the Planning Act, the appropriate signage acknowledging the application was installed on the subject lands. In addition, the appropriate notice was mailed to each landowner within the prescribed distance. 7 .2 As of the writing of this report, no written submissions have been received. 8. AGENCY COMMENTS: 8. 1 In accordance with departmental procedures, the application was circulated to obtain comments from other departments and agencies. The following departments/agencies in providing comments, offered no objection to the application as filed: - Town of Newcastle Fire Department - Ministry of Natural Resources - Ministry of Agriculture and Food 8.2 Some agencies had no objection to the application provided that their comments/concerns are adequately addressed. . . . 4 REPORT NO. : PD- 50 -90 PAGE 4 The Town of Newcastle Community Services Department requested that 5% cash-in-lieu of parkland be provided by the applicant/owner with the funds being credited to the Park Reserve Account. The Town of Newcastle Public Works Department asked that a 5.0 metre site triangle on Reid Road be dedicated to the Town, that the applicant/owner reconstruct Reid Road from Highway No. 2 to "A" Court to Town Standards, that the applicant/owner will bear the costs ( 100%) of any works on Reid Road, Hill Street and Ovens Road which are necessitated as a result of this development, that the applicant/owner contribute to the cost of reconstructing/upgrading Reid Road from "A" Court to Hill Street ($152 . 00/m X 150.00m = $22,800. 00) and that a Master Drainage Study and Lot Grading Plan be completed to the satisfaction of the Director of Public Works. The Durham Region Department of Health noted that before they can comment on this application, several reuqirements must be met. These include a lot servicing plan, a testing of soil samples, a hydrogeological report, environmental impact study and an existing and final grading plan. The Ganaraska Region Conservation Authority requested that a surface drainage and erosion control plan be prepared in order to control Stormwater Drainage and sediment movement during and after construction. The Ministry of Transportation had no objection to the application provided that there will be no direct access to Highway No. 2 and that any residential dwelling must be setback a minimum distance of 7 .5m (25 ft. ) from the highway property line or 26m ( 85 ft. ) from the centre line, whichever is greater. This Ministry also noted that building/land use and sign permits are required prior to any construction being undertaken. . . .5 522 REPORT NO. : PD- 50 -90 PAGE 5 8. 3 At the time of writing this report comments have yet to be received from the following agencies: - Durham Regional Works Department - Northumberland & Newcastle Board of Education - Peterborough-Victoria-Northumberland and Newcastle Roman Catholic Separate School Board - Ministry of the Environment - Bell Canada - Ontario Hydro 9 . STAFF COM4ENTS: 9 . 1 Staff notes that municipal water is being extended to Newtonville and that this applicant has entered into a Servicing Agreement with the Durham Region Works Department for twelve ( 12) residential units . 9 .2 The lot sizes for this application range from 0.2 ha to 0. 3 ha. Section 9 .4(ix) of the Town of Newcastle Official Plan permits the minimum lot size in Newtonville to be reduced to 0.2 ha provided that a detailed Engineering Report is submitted. This report must satisfy the Town, the Region and the Ministry of Environment that the site's soil conditions can support a reduced lot size without causing soil and groundwater contamination. 9 . 3 A hydrogeologic assessment has been submitted to the Planning Department. this report states that "the proposed residential use of the subject lands is suitable for the planned development provided that those provisions which are further specified in the report are satisfied. The report noted that the long term levels of nitrate accumulation would exceed provincial drinking water standards if the recharge area is limited to the subject site. However, it was noted that if the other lands (5 . 65 ha) held by the owner remain undeveloped, this could be used as an additional recharge area for the subject site. This would result in decreasing the projected long term level of nitrate to a level which satisfies the provincial drinking water objective. REPORT NO. : PD- 50 -90 PAGE 6 10. CONCLUSION: 10. 1 As the purpose of this report is to satisfy the requirement for a public meeting under the Planning Act, and in consideration of the agency comments outstanding, it is recommended that the application be referred back to Staff for further processing.
