SUBJECT: REZONING APPLICATION - COWAN PONTIAC BUICK LIMITED
PART LOT 11, CONCESSION 11 FORMER TOWN OF BOWMANVILLE
RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. THAT Report PD- 55 -90 be received;
2 . THAT Rezoning Application DEV 88-93 submitted by Tom Cowan on
behalf of Cowan Pontiac Buick Limited to permit a parking area
be approved;
3 . THAT the amending by-law attached hereto be forwarded to
Council for approval;
4 . THAT a copy of this report and the amending by-law be
forwarded to the Region of Durham Planning Department;
5. THAT the amending by-law be circulated in accordance with
regulations made under the Planning Act;
6 . THAT the "H" - Holding Symbol in the amending by-law will not
be removed until such time the applicant has entered into a
site plan agreement with the Town;
7 . THAT any delegation and those persons listed in this report
be advised of Council's decision.

1. APPLICATION DETAILS
1. 1 Applicant: Tom Cowan
1.2 Owner: Cowan Pontiac Buick Limited
1. 3 Rezoning: From "Urban Residential Type One Exception (R1-12) "
To an appropriate zone to permit the establishment
of a parking area.
1.4 Area: 1028 metres square
2. LOCATION
2 . 1 The subject property is located in Part Lot 11, Concession 1,
former Town of Bowmanville, further defined as 39 and 41
Church Street.
3. BACKGROUND
3 . 1 The Town of Newcastle Planning Department received an
application to amend the Town of Newcastle Comprehensive
Zoning By-law 84-63 as amended to permit the establishment of
a "Parking Area" for the use of Cowan Pontiac Buick Limited.
This application was received on September 1, 1988. Also on
this date, an Official Plan Amendment was submitted for this
subject property.
3 .2 On May 8, 1989, the Town of Newcastle Council approved the
Rezoning Application and the Official Plan Amendment attached.
3 . 3 On November 29, 198, the Official Plan Amendment was approved
by the Region as Amendment No. 33 to the Town of Newcastle
Official Plan. This Amendment effectively redesignates the
subject property from "Residential" to "Commercial" .
4. ZONING
4 . 1 The subject property is presently zoned "Urban Residential

Exception (R1-12 ) " . Lands so zoned shall be predominantly used
for converted semi-detached and duplex dwellings .
4 .2 This application would amend the zoning to "Holding-Urban
Residential Exception " (H) R1-24" which would permit the
subject site to be used as a "Parking Area" . However, for the
purpose of interpretation, the definition of "Parking Area"
as defined in Section 3 of the Town of Newcastle Comprehensive
Zoning By-law 84-63, as amended, shall not include a private
garage, structure or building of any kind.
5. CONCLUSION
5 . 1 Staff note that prior to removal of the "Holding (H) " symbol,
the Directors of Public Works and the Planning Department must
be satisfied that the applicant/owner has entered into a Site
Plan Agreement with the Town.

THE CORPORATION OF THE TOWN OF NEWCASTLE
BY-LAW NUMBER 90-
being a by-law to amend By-law 84-63, the Comprehensive Zoning By-
law of the Corporation of the Town of Newcastle
WHEREAS the Council of the Corporation of the Town of Newcastle
deems it advisable to amend By-law 84-63, as amended, of the
Corporation of the Town of Newcastle;
NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation
of the Town of Newcastle enacts as follows:
1. Section 12.1 "Urban Residential Type One (R1) " zone is hereby
amended by adding thereto the following new Special Exception
12.4.24 as follows:
"Notwithstanding Section 12.1, the lands zoned "R1-24"
on the schedules to this by-law may only be used as a
"Parking Area".
For the purpose of this provision, the definition of
"Parking Area" shall not include a private garage,
structure or building".
2. Schedule 113" to By-law 84-63, as amended is hereby further
amended by changing to "(H)R1-24" the zone designation of the
lands indicated as "ZONE CHANGE FROM R1-12 to (H)R1-24" as
indicated on the attached Schedule "A" hereto.
3. Schedule "A" attached hereto shall form part of this By-law.
4) This by-law shall come into effect on the date of passing
hereof, subject to the provisions of Section 34 of the
Planning Act. -•-- -
