THAT Report PD-59-90 be received; 2 . THAT application to amend the Town of Newcastle Comprehensive Zoning By-Law be approved and the By-law attached be forwarded to Council for approval; 3 . THAT a copy of this report and the amending by-law be forwarded to the Region of Durham Planning Department; 4 . THAT the amending by-law be circulated in accordance with regulations made under the Planning Act; 5. THAT the "Holding (H) " symbol in the amending by-law will be removed as a condition of approval of Land Severance; and 6 . THAT the interested parties listed in this report and any delegation be advised of Council's decision. . . .2 REPORT NO. : PD-59-90 PAGE 2 1. APPLICATION DETAILS 1. 1 Applicant: Mr. Nick Palladino 1.2 Owner Mr. Nick Palladino 1. 3 Rezoning From "Agricultural (A) " to the appropriate zone to permit the development of one additional lot for semi/link dwellings 1.4 Area: 0 .252 hectares 2 . LOCATION 2 . 1 Legal Description: Part Lot 30, Concession 3, former Township of Darlington, (Courtice Major Urban Area) 2 .2 Relative Location: 291 m (956 ft) north of Nash Road on the East side of Trulls Road 3. BACKGROUND 3 . 1 The application to amend the Comprehensive zoning By-Law was made on July 7, 1989 by Mr. Nick Palladino on behalf of Mr. J. Masters . This application was to permit the development of one additional lot for a single detached dwelling. The subject lands were subsequently purchased by Mr. Palladino and the application revised on October 23, 1989 to permit the development of semi/link dwellings. 4 . EXISTING AND SURROUNDING USES: 4 . 1 Existing Uses: single family residential 4 .2 Surrounding Uses: East- vacant West- residential subdivision North- currently vacant; also the subject of Subdivision Application 18T-88067 South- residential . . . 3 `� 86 REPORT NO. : PD-59-90 PAGE 3 5 . OFFICIAL PLAN POLICIES 5 . 1 Durham Region Official Plan The subject site appears to be located within the Residential" designation in the Durham Region Official Plan. The predominant use of lands so designated shall be for residential purposes . It should be noted that the Durham Plan requires all development to be on full services with sanitary sewer and water supply services unless prior arrangement is made with the Region for future service connection. 5.2 Town of Newcastle Official Plan Within the Town of Newcastle Official Plan (Courtice Major Urban Area) , the subject lands are designated "Residential" . The proposal appears to comply with the applicable Official Plan provisions . 6 . ZONING 6 . 1 The subject lands are currently zoned "Agricultural (A) " by By-law 84-63, in the Town of Newcastle Comprehensive Zoning By-law. 6 .2 The proposed rezoning application would change the zoning to an appropriate "Residential" category to permit the proposed development. 7 . PUBLIC NOTICE 7 . 1 Pursuant to the requirements of the Planning Act and Council policy, notice of the Public Meeting with respect to the rezoning amendment submitted by Mr. Nick Palladino was mailed to all property owners with 120m (400) of the subject site. In addition, the appropriate signage acknowledging the application was installed on the subject lands. . . .4 58 / REPORT NO. : PD-59-90 PAGE 4 7 .2 As of the writing of this report, no written submissions have been received. 8 . COMMENTS FROM AGENCIES 8 . 1 In accordance with departmental procedures, the application was circulated to obtain comments from other departments and agencies . The following departments/agencies in providing comments, offered no objection to the application as filed: - Town of Newcastle Fire Department - Durham Regional Health Department - Ministry of Agriculture and Food - Region of Durham Planning Department 8.2 Staff notes that the Town of Newcastle Community Services Department requested that the 5% park land dedication be accepted as cash-in-lieu. 8. 3 The Town of Newcastle Public Works Department asked that the Applicant will bear the cost ( 100%) of any works on Trulls Road which are necessitated as a result of this development and that monetary contributions are made to the reconstructing/upgrading of Trulls Road ( 15m x $476 .50/m = $7, 147 .50) . In addition, it was requested that a satisfactory lot grading plan be submitted and that a 5 . 18m road widening be dedicated to the Town along with a 0 . 3m reserve. The Public Works Department also asked that any easements required by the Town be granted free and clear of any encumbrances and that an application for property access be made. 8.4 Durham Region Public Works Department noted initially that sanitary sewer services are not presently available to service the subject property and that the applicant will be responsible for the entire cost of extending sanitary sewer services. The estimated cost for the extension is $46,000. 00, ( 1989 rates) . Revised comments indicated that sanitary sewers will be constructed in conjunction with the Town's Work . . .5 REPORT NO. : PD-59-90 PAGE 5 Program for the upgrading/reconstruction of Trulls Road between Nash and George Reynolds Drive. It is Staff's understanding this program is tentatively scheduled for Spring, 1990 . Staff would note municipal water services presently front the subject lands. 9 . STAFF COMMENTS 9 . 1 In consideration of the comments received, Staff are of the opinion that the approval of the rezoning application using the Holding (H) symbol would be appropriate inasmuch as no building or structure may be erected and no use may be established in the "Urban Residential Type One (R1) " Zone unless the lot upon which it is situated is serviced by municipal sewage and water systems which have sufficient capacity to accommodate the proposed use. 9 .2 Staff would confirm that the related comments of the various Town Departments would be incorporated into the comments submitted to the Land Division Committee for the proposed severance applications . 9 .3 In light of the above, no further rezoning application would be necessary to remove the "Holding (H) " symbol. 10. WHEREAS The Council of the Corporation of the Town of Newcastle deems it advisible to amend By-law 84-63, as amended, of the Corporation of the Town of Newcastle in consideration of the application DEV 89-92; NEW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the Town of Newcastle enacts as follows: 1. Schedule 114" of to By-law 84-63, as amended, is hereby further amended by changing the zone designation from: "Agricultural (A) " to "Holding - Urban Residential Type One ( (H)R1) ". 2. Schedule "A" attached hereto shall form part of the By-law. 3. This By-law shall come into effect on the date of passing hereof, subject to the provisions of Section 34 of the Planning Act.
