THAT Report PD- 66 -90 be received; 2 . THAT application to amend the Town of Newcastle Comprehensive Zoning By-law 84-63, as amended, submitted by Tunney Planning on behalf of the Quadrillium Corporation be referred back to Staff for further processing and the preparation of a subsequent report upon receipt of all outstanding comments; and 3 . THAT the interested parties listed in this report and any delegation be advised of Council's decision. 1. APPLICATION DETAILS 1. 1 Applicant: Tunney Planning 1.2 Owner: The Quadrillium Corporation 1. 3 Subdivision - Single Family - 64 lots - Commercial Block - 0. 649 ha - Park Block - 2 .27 ha 1.4 Rezoning - From "Residential Hamlet (RH) " , "Agricultural (A) " and "Environmental Protection (EP) " to an appropriate zone to implement the proposed 64 unit subdivision and a convenience commercial block. 1.4 Area: 23 . 18 ha . . .2 REPORT NO. : PD- 66 -90 PAGE 2 2 . LOCATION 2 . 1 The subject property is located in Part Lot 8, Concession 1, former Township of Clarke. This property is further defined as being east of Regional Road # 18, south of Highway # 2 in the Hamlet of Newtonville. 3 . BACKGROUND 3. 1 An application to change the zoning category of a 23 . 18 ha parcel of land located in part Lot 8, Concession 1, former Township of Clarke was received on November 30, 1987 . On December 2, 1987 a subdivision application was submitted for this same property. The original submission proposed 66 single family units and a 60 + unit motel. 3.2 A public meeting was held on February 15, 1988 which addressed this application. Since that time this application has been revised to 64 single family units and a 500 m2 convenience commercial establishment. 4 . EXISTING AND SURROUNDING USES 4 . 1 Existing Uses: Vacant 4 .2 Surrounding Land Uses: East - vacant West - residential, institutional and vacant South - Highway 401 North - Existing Residential 5 . OFFICIAL PLAN POLICIES 5 . 1 According to the Town of Newcastle Official Plan, the subject property is designated "Residential Infilling" , "Residential . . . 3 REPORT NO. : PD- 66 -90 PAGE 3 Expansion" , "Neighbourhood Park" and "Area Subject to Development Restrictions" . Those areas designated "Neighbourhood Park" and "Area Subject to Development Restrictions" have been considered in the proposal and appear to comply to the Official Plan. The remainder of the property has been designated for residential development. Limited Commercial development is permitted in Residentially designated areas under Section 8. 1.2 . 1 c) of the Durham Regional Official Plan. 6 . ZONING 6 . 1 The parcel in question is zoned "Residential Hamlet (RH) " , "Agriculture (A) " and "Environmental Protection (EP) " . The property must be appropriately zoned prior to any building permits being issued. 7 . PUBLIC NOTICE AND SUBMISSIONS 7 . 1 Pursuant to Council's resolution of July 26, 1982 and the requirements of the Planning Act, the appropriate signage acknowledging the application was installed on the subject lands. In addition the appropriate notice was mailed to each landowner within the prescribed distance. 7 .2 A number of written submissions were received in 1988 regarding this application. Mrs . Jean Hall and Miss Berneice Milligan of Newtonville and Charlene Bowman (R.R.#1 Port Hope, Ontario L1A 3V5) wrote letters noting their difficulty in obtaining a severance for one lot and the subsequent restrictions placed on development of this lot. In their letters they stressed their belief that "Developers" and local citizens were not being treated equitably. A letter was also received from Mr. Donald Robins (Box 36, Newtonville, Ont. LOA 1JO) . Although Mr. Robins did not object to this application, he did have some concerns regarding the number of units and the subsequent effect on existing wells . The fact that their is only one access proposed for this subdivision also gave Mr. Robins some concern. . . .4 REPORT NO. : PD- 66 -90 PAGE 4 7 . 3 At the Public Meeting held on February 15, 1988, three people spoke in opposition to this application. Mr. Sandy Lyall (Box 93, Newtonville) noted concern regarding the amount of traffic that would be generated on Jones Avenue. Mr. Ray Tompkins of Jones Avenue in Newtonville is opposed to development in Newtonville, and Martha Gibson (Box 121, Newtonville) voiced her concerns about a motel unit being located close to the school. 8 AGENCY COMMENTS 8.1 In accordance with departmental procedures, the application was circulated to obtain comments from other departments and agencies. The following department/agencies in providing comments, offered no objection to the application as filed: - Peterborough-Victoria-Northumberland & Newcastle Roman Catholic Separate School Board. - Newcastle Hydro Commission - Ministry of Natural Resources 8 .2 A number of agencies had no objection to this application provided that their concerns are dealt with. The Town of Newcastle Fire Department has no objection, however it was noted that this development could place a strain on the level of service. Community Services requested: that Block 66 be deeded to the Town for Parkland; that the Public School Board and Town agree to a master plan for the joint development of the park and school lands; that a soccerfield, ball diamond, play ground apparatus, landscaping, drinking fountain, water chamber, pathways and irrigation line be provided prior to receiving 26% of their building permits; and that a landscape consultant be obtained to design the joint servicing of the Park and School lands . Town of Newcastle Public Works Department requested that the applicant/owner cover the cost ( 100%) of road construction on Rose Crescent and Jones Avenue. Regional Works Department wanted a 7 foot road widening and a 1 ft. reserve along Regional Road # 18. . . .5 -'0 REPORT NO. : PD- 66 -90 PAGE 5 The Health Unit asked that test holes be dug for their inspection, that a lot servicing drawing be prepared which shows the size of each lot, that a lot numbering plan be provided and that plans showing ditches or swales across the rear yards of lots which abut adjacent lots be submitted. The Ganaraska Region Conservation Authority had no objection to this application provided that those lands zoned "Environmental Protection (EP) remain so zoned. The Northumberland Newcastle Public School Board had no objection provided that a chain link fence be built around the school lands, that sidewalks along the eastern side of Regional Road # 18 be built, and that a walkway be provided to the subdivision from the east or north side of the school. The Ministry of Transportation requested that all buildings must be situated at least 14 m from the Highway property line, and that Ministry permits are required for all buildings, signs and illumination located within 395 m of the centre point of the 401 and Regional Road # 18 intersection. The Ministry also requested that a drainage plan be submitted. Ontario Hydro noted that there exists some low voltage overhead lines affecting lots 4 to 7 . These lines will have to be relocated at the cost of the owner/applicant. They also requested that all their easement rights be protected and maintained. 8 . 3 At the time of the writing of this report, comments remain outstanding from the Ministry of the Environment. 9 STAFF COMMENTS 9 . 1 Staff notes that the applicant/owner has contributed to the cost of the Newtonville Municipal Water System for a total of 66 units. It has been determined by the applicant that the convenience commercial development would be equivalent to two single family dwellings in terms of water consumption. . . .6 1 �} �X REPORT NO. : PD- 66 -90 PAGE 6 10 . CONCLUSION 10 . 1 As the purpose of this report is to address the requirements of a Public Meeting under the Planning Act, and in consideration of the comments outstanding, Staff recommend that this application be referred back to Staff for further processing.
