General Purpose and Administration Committee DATE: Monday, February. 19, 1990 REPORT #: PD- 70 -90 FILE #: DEV 87-66 (LD 515/87) SUBJECT: REZONING APPLICATION - HALL/MILLIGAN PART LOT 7, CONCESSION 2, FORMER TOWNSHIP OF CLARKE FILE: DEV 87-66 (LD 515/87) RECOMMENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PD- 70 -90 be received; 2 . THAT Rezoning Application DEV 87-66 submitted by J. Hall and A. Milligan to permit the development of one ( 1) residential lot be APPROVED; 3. THAT the amending by-law attached hereto be forwarded to Council for approval; 4. THAT a copy of this report and the amending by-law be forwarded to the Region of Durham Planning Department; 5. THAT the amending by-law be circulated in accordance with regulations under the Planning Act; 6 . THAT the interested parties listed in this report and any delegation be advised of Council's decision. 1. APPLICATION DETAILS 1. 1 Applicant: J. Hall and B. Milligan 1.2 Rezoning: From "Agricultural Exception (A-1) " to "Residential Hamlet (RH) " to allow the creation of one residential lot 1. 3 Area: 1005 m2 (0.24 acre) . . .2 REPORT NO. : PD- -90 PAGE 2 2 . BACKGROUND 2 . 1 The subject rezoning application was submitted in support of a Land Severance application located in Part Lot 7, Concession 2, former Township of Clarke, hamlet of Newtonville. The proponents proposed to sever approximately 0 . 3 HA (0.75 acre) from a 2 .5 ha. (6 .2 acre) farm partially within the Newtonville Hamlet boundaries . 2 .2 On December 7, 1987, Council approved the rezoning application in principle, subject to, a By-law being forwarded to Council, at such time as a 0 . 3 Metre Reserve was conveyed to the Town on all but 10 Metres of frontage on the retained lands . 2 . 3 In July of 1988 the Town received a registered copy of the deed conveying the 0 . 3 Metre Reserve to the Town, therefore, it is now in order to recommend Council approval of the attached By-law to allow the creation of one ( 1) additional lot within the Newtonville Hamlet boundaries . Box 208 NEWTONVILLE, Ontario PORT HOPE, Ontario LOA 1J0 L1A 3W3 THE CORPORATION OF THE TOWN OF NEWCASTLE BY-LAW NUMBER 90- being a By-law to amend By-law 84-63, the Comprehensive Zoning By- law for the Corporation of the Town of Newcastle. WHEREAS the Council of the Corporation of the Town of Newcastle deems it advisable to amend By-law 84-63, as amended, of the Corporation of the Town of Newcastle to implement Application Dev 87-66 . NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the Town of Newcastle enacts as follows: 1. Schedule 1117 " to By-law 84-63 as amended, is hereby further amended by changing the zone designation from: "Agricultural Exception (A-1) " to "Residential Hamlet (RH) " as indicated on Schedule "A" hereto. 2 . Schedule "A" attached hereto shall form part of this By-law. 3. This By-law shall come into effect on the date of the passing hereof, subject to the provisions of Section 34 of the Planning Act. BY-LAW read a first time this day of 1990 . BY-LAW read a second time this day of 1990 . BY-LAW read a third time and finally passed this day of 1990 .
