THAT Staff be authorized to advertise in local newspapers to advise the general public of the date and time of a Public Meeting to be held in relation to the proposed amendment to the Comprehensive Zoning By-law to amend the minimum lot size requirement in the 'Residential Hamlet (RH) l Zone. 1. BACKGROUND 1. 1 The Town of Newcastle Official Plan (Section 9 .4 viii) states that the minimum lot size for new residential lots in hamlets with or without municipal water systems shall be 0 .4 ha (4000 sq.m. ) . Reduction of the minimum lot size requires an amendment to the Plan. 1.2 Virtually all hamlet residential lands in the Town, with the exception of Orono, are zoned 'Residential Hamlet (RH) I Zone by the Town's Comprehensive Zoning By-law. Section 9 of the By-law, which outlines the zone provisions for the IRHI zone, indicates the minimum lot area for new lots in the IRHI zone to be 3000 sq.m. (0 .3 ha) . 2 . STAFF COMMENTS 2 . 1 Staff propose to bring the minimum lot area requirement for hamlet residential lots in the Comprehensive Zoning By-law into conformity REPORT NO. : PD-99 -91 PAGE 2 with the Town of Newcastle Official Plan. The proposed amendment to By-law 84-63 would amend the provisions of the 'Residential Hamlet (RH) Zone' by increasing the 'Lot Area (minimum) ' from 3000 square metres to 4000 square metres (Section 9 .2 .a) . 2 .2 Prior to Town Council passing an amendment to the Comprehensive Zoning By-law, the Planning Act requires the Municipality to hold a Public Meeting and further requires that notice be provided to the affected residents . 2 .3 The proposed amendment would apply to every hamlet in the Town, with the exception of Orono. Staff do not consider it practical to provide notice by pre-paid first class mail to every property owner and tenant within the 'RH' zone. In order to satisfy the requirements of the Planning Act with respect to public notice, it is therefore recommended that notice be placed in local newspapers.
