OP 3.5(5) ) RECOMMENDATIONS: It is respectfully recommended ' that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PD- 40 -90 be received; 2 . THAT the application to amend the Haydon Hamlet Plan, now part of the Official Plan for the Town of Newcastle,submitted by Kathryn Harrison, on behalf of Wolfgang Hryciuk and Cynthia Savage to permit the creation of four (4) lots through the consent process, be approved; 3 . THAT Zoning Amendment Application DEV 87-56 be approved; 4 . THAT the amending by-law be passed at such time as the related Official Plan Amendment has been adopted by Regional Council; 5 . THAT the Region of Durham and those persons listed at the end of this report be advised of Council 's decision; and 6 . THAT the Region of Durham Planning Department be forwarded a copy of Report PD- 4�O -90. 1. BACKGROUND 1. 1 In July of 1987, the Town of Newcastle Planning and Development Department received an application to amend both the Haydon Hamlet Plan and the Town of Newcastle Zoning By- 2 J � � i REPORT NO. .. PD- 40 -90 PAGE. . .2 law 84-63 in order to permit the creation of six (6) residential lots through the consent process . The application has subsequently been revised and now proposes the creation of four (4) residential lots). 1.2 The subject site is a 2 .72 hectare (6 .72 acre) parcel located on the west side of Maple Street, now formally described as Part of Lot 14, Concession) 8, in the former Township of Darlington. 2. PUBLIC NOTICE 2 . 1 For the Committee's information, pursuant to Council's resolution of July 26, 1982 and the requirements of the Planning Act, the appropriate signage acknowledging the application was erected on the subject lands and the appropriate notice was mailed to each landowner within the prescribed distance. 2 .2 Furthermore, in view of the substantial length of time which has passed since the original public meeting, the Planning and Development Department has provided notice of this meeting to each landowner within the prescribed distance. 2 . 3 As of the writing of this report, the Planning and Development Department has not received any public submissions with respect to the subject application. 3. OFFICIAL PLAN CONFORMITY 3 . 1 Within the Durham Regional Official Plan, the property is designated as Permanent Agricultural Reserve. Furthermore, the subject property is located outside of the limits of the Haydon Secondary Hamlet Plan.IlTherefore, the applicant applied in July of 1987 to amend the Haydon Hamlet Plan and this application, in view of theicurrent policies, is now being . . .3 588 II I� REPORT NO. : PD- 40 -90 PAGE. . 3 Considered as an amendment to the Town of Newcastle Official Plan. 4. ZONING BY-LAW CONFORMITY 4 . Within the Town of Newcastle Comprehensive Zoning By-law 84- 63, the subject property is zoned Agricultural - Special Exception (A-1) . As residential uses of the size and magnitude proposed in the subject application are not permitted within the current zone category, the applicant has also applied to appropriately amend the Zoning By-law. 5. AGENCY COMMENTS 5. 1 The subject application was circulated to various agencies by the Town of Newcastle Planning and Development Department. The following provides a summary of the comments received. 5.2 The Town of Newcastle Public Works Department has reviewed the subject application and has no objection to the proposal, subject to the provision of certain regulatory conditions. Firstly, that the Owner bears the costs ( 100%) of extending Maple Street +/- 500 feet to the north in accordance with Town Policy. Secondly, that the Owner contributes to the costs of upgrading the maintained portion of Maple Street, +/- 150 feet. Thirdly, that the Owner pays the cost of street lighting, satisfactory to the Director of Public Works. Fourthly, that all of the ,'Town's standard conditions and requirements with respect to easements, roads, services and grading be complied with. However, for the Committee's information, these conditions will be imposed once the proposed lots have been created through the consent process . 5. 3 The Durham Regional Health Department has reviewed the subject application and offers no objection to the proposal. However, the Health Department states ' that the number of lots suitable . . .4 i REPORT NO. : PD- 40 -90 PAGE. . .4 for on site sewage disposal will be determined once the severance application is circulated. 5 .4 The Ministry of the Environment has reviewed the subject application and offers no objection, in view of the reduction in the number of proposed lots from six (6) to four (4) . 5 .5 The balance of the circulated agencies which provided comments i were the Town of Newcastle Fire Department, Ontario Hydro, the Central Lake Ontario Conservation Authority, the Regional Planning Department, the Ministry of Agriculture and Food and the Separate School Board. None of the aforementioned agencies provided objectionable comments . 6. STAFF COMMENTS 6 . 1 Staff have reviewed the proposal with respect to the policies of the Durham Regional Official Plan. Section 10 .4 . 1.4 of the Durham Regional Official Plan states that Hamlets which are not identified as Hamlets for Growth shall be limited to minor internal infilling and/or minor additions . The Town of Newcastle Planning and Development Department considers the creation of four (4) additional residential lots as a minor addition to the hamlet of Haydon. I 6 .2 Furthermore, Staff have reviewed the subject application in relation to the existing Secondary Hamlet Plan. The Planning and Development Department considers the extension of the limits of the Secondary Hamlet Plan in a north-westerly direction as logical, given the environmentally sensitive area which traverses the Secondary Hamlet Plan from the south-west to the north-east. 6 . 3 Additionally, given the 2 . 72 hectare (6 . 72 acre) size of the subject parcel, the Planning and Development Department is . .5 } 9 II REPORT NO. : PD- 40 -90 PAGE . . .5 confident that the applicant will have sufficient land within which four (4) residential lots and services could be accommodated without adversely impacting on abutting property owners . 7. CONCLUSION 7 . 1 In view of the foregoing, Staff would have no objection to the proposal and would respectfully recommend that the proposal be approved an amendment to the Town of Newcastle Official Plan. LOCATION: The subject property is located to the north of the Hamlet of Haydon , along the west side of Maple Street, directly abutting the present northerly limits of the Hamlet Secondary Plan, being part of Lot 14, Concession 8, in the former Township of Darlington. BASIS: The modification is the result of an application to expand the limitsof the Hamlet boundary in order to permit the creation of four (4) residential lots through the consent process . A hydrogeological study, reviewed bylthe Ministry of the Environment, has indicated that soil and water conditions are suitable for the development of four (4) residential lots on private services . ACTUAL AMENDMENT: The Hamlet of Haydon Secondary Plan is hereby modified as follows: 1) By extending the Hamlet boundary to incorporate the subject ' lands to be designated as "Residential Expansion" as indicated on Schedule "A" attached.
