THAT Report PD-87-91 be received; 2 . THAT application to amend the Town of Newcastle Comprehensive Zoning By-law 84-63, as amended, submitted by Ray Abbott on behalf of Newcastle Townline Centre be referred back to Staff for further processing and the preparation of a subsequent report upon receipt of all outstanding comments; and 3 . THAT the Durham Region Planning Department,, and all interested parties listed in this report and any delegation be advised of Council 's decision. 1. APPLICATION DETAILS 1. 1 Applicant: Ray Abbott 1. 2 Owner: Newcastle Townline Centre, 667831 Ontario Ltd, Allan Sue, Gary Russell Beaven & Jean Louise McFarland Beaven. 1 . 3 Rezoning: From Urban Residential Type One (Rl) to a zone to permit the proposed commercial establishment. 1.4 Official Plan Amendment: from Residential to a designation appropriate to permit the proposed commercial establishment. 2 REPORT NO. PD-87-91 PAGE 2 1.5 Neighbourhood Plan Amendment: from Residential to a designation appropriate to permit the proposed commercial establishment. 1.6 Area: 0 . 36 hectares ( 0 .89 acres) 2 . LOCATION 2 . 1 The subject property is located in Part of Lot 32, Concession 2 in the former Township of Darlington. The lands consist of four (4) separate properties being 1565, 1567, 1571, and 1573 Highway No. 2 . The land is located on the south side of Highway No. 2, between Prestonvale Road and Sandringham Drive. 3 BACKGROUND 3 . 1 On December 20, 1990, the Planning Department received an application to amend the Town of Newcastle Comprehensive Zoning By-law 84-63 and the Neighbourhood Plan to permit the establishment of a 1350 mz ( 14531 . 7 sq. ft. ) retail commercial/strip plaza. Shortly there after an application for Official Plan Amendment was received. 3.2 The four separate properties are all represented by Newcastle Townline Centre. Presently, three of the properties have single dwelling units located on the lands . On the fourth property, a residential unit and a personal service use are contained within the existing structure. This use is better known as "Courtice Unisex Hairstyling" . 4 EXISTING AND SURROUNDING USES 4 . 1 Existing Uses: three single dwelling units and a personal service use with a residential unit. 4 .2 Surrounding Uses : East - Andy's Garage West - Prestonvale Plaza South - Existing Residential Dwellings North - Existing Residential Dwellings . . . .3 REPORT NO. PD-87-91 PAGE 3 5 OFFICIAL PLAN POLICIES 5. 1 According to the Durham Region Official Plan, the Town of Newcastle Official Plan and the Courtice South Neighbourhood 2B Plan, the subject lands are designated "Residential" . 5.2 According to Section 8 . 1.2 . 1 a) of the Durham Region Official Plan, and Section 8 . 2 . 1.2 ii) d) of the Town of Newcastle Official Plan, convenience commercial uses under 465 square metres (5000 square feet) are permitted in "Residentially" designated areas . Commercial uses exceeding 465 square metres, or uses not of a "convenience" nature shall not be permitted in areas designated "Residential" . 6 ZONING BY-LAW PROVISIONS 6 . 1 The subject lands are zoned "Urban Residential Type One (Rl) " . Lands so zoned shall be used for residential purposes. 7 PUBLIC MEETING AND SUBMISSION 7 . 1 Pursuant to Council's Resolution of July 26 , 1982 and the requirements of the Planning Act the appropriate signage acknowledging the application was installed on the subject lands. In addition, the appropriate notice was mailed to each landowner within the prescribed distance. 8 AGENCY COMMENTS 8 . 1 In accordance with departmental procedures, the application was circulated to obtain comments from other departments and agencies . The following departments/agencies in providing comments, offered no objection to the application as filed: Town of Newcastle Fire Department Northumberland and Newcastle Board of Education Peterborough, Victoria, Northumberland and Newcastle Roman Catholic Separate School Board Ministry of Natural Resources Bell Canada h . . . .4 wi i REPORT NO. PD-87-91 PAGE 4 8 .2 Comments have been received from the Town of Newcastle Community Services Department, Public Works Department, and from the Region of Durham Planning Department. Community Services requested that a high quality of materials and plantings be apparent in the site's landscape treatment, that 4 " calliper trees on 40 foot centres be planted on the road allowance, and that the 2% cash-in-lieu of parkland be credited to the Parks Reserve account. The Public Works Department requested that site plan approval does not proceed until engineering drawings have been submitted and approved. A Master Drainage and Site Grading Plan is also required. The applicant/owner must also provide a cash contribution for sidewalks ($6750 . 00) and for illumination ( $6300 . 00) along Highway No. 2 . The Durham Region Planning Department requested that if approved, a by-law not be forwarded until such time as the Official Plan Amendment application has been dealt with. 8. 3 Comments have yet to be received from the following agencies: Central Lake Ontario Conservation Authority Durham Region Works Department Ministry of Transportation Ontario Hydro 9 STAFF COMMENTS 9 . 1 It is noted that the property owned by Allan Sue ( 1567 Highway No. 2) was subject to a rezoning application in 1989 (DEV 89- 119) to permit a 241 mz (2600 sq. foot) convenience commercial establishment. This application was denied at the January 29, 1990 meeting. 10 CONCLUSION 10 . 1 The purpose of this report is to facilitate the Public meeting as required by the Planning Act, to provide Committee and Council with some background on the application submitted and for Staff . . . . 5 REPORT NO. PD-87-91 PAGE 5 to indicate issues or area of concern regarding the subject application. It is recommended the application be referred back to Staff for further processing and subsequent report upon resolution of the above issues and receipt of all outstanding comments and required revisions .
